It's jammed in the open position. Grab a screwdriver and have a poke about (there's probably s technical term for that) to see if it will release.
Once it's shut don't open it again until you can replace the catch!
As Chris says ^ that's what the law requires you to have to accompany a learner.
You don't even need to be insured on the car as long as the learner is then it's fine! So I'd say yeah crack on!

That looks broke to me! Replace them both if you can.
Dampers usually look wet when they've gone, and if you bounce the car it'll keep bobbing for a bit after you stop.
