Insurance - I'm in the money...

i got hit in the rear of my car mid last year by a young lad and had to get my car sorted etc, i didnt make a whiplash claim because i didnt believe i had and didnt want to be dishonest.

anyway got a phonecall from the lads insurance today saying basically they expected me to make a personal injury claim because of the accidents circumstances, and were ringing to see if i wanted to claim the money.

basically asked if i have any pains in my neck etc, i do have a small pain in my neck when i tilt my head to the right, had it for as long as I can remember, never thought to link it to the accident, but i explained this, and said 'i didnt think it would be linked to the accident' (exact words) and then its gone from there with them filing the injury claim!

as i said i didnt want to claim because i didnt feel i had a reason to claim, and i know everyone does it but i didnt want to be dishonest, but from what has been explained to me they have accounted it as a personal injury claim and took the money from his insurance and were expecting me to call up and report the claim.

as i said i have not lied, i've said i didnt think it was linked to the accident and cannot remember when i began having the pain, but anyway if they want to decide that it is whiplash related injuries then f**k it, let them do it!
after all, he did crash into me! now i dont want to come across an arsehole, i dont need the money and i havent told any lies, but if they feel i should be given a few grand for my trouble then i wouldnt want to challenge them, and as his insurance has already footed a personal injury claim and have the money waiting, he has already taken this into account in his insurance and wont be getting it back so i may aswell have the ££££'s!

anyone think im an arsehole/liar/cheat etc?

i really got screwed when i crashed , i did have wiplash and concusion, and i still have a scar 2 years later.. i got told to bugger off and didnt get a penny, even tho the guy was blind drunk

my mate who was in the car got over a grand from a bruise on her leg

not sure how much, i havent asked, to be honest i doubt I will get anything cos i havent exactly been pushing to get it, just making sure whatever i say doesnt discriminate me in case they think i'm lying.

they proper twist your words though!

i got hit by an uninsured driver, my knee hit the sterring column of my car, was signed off work for a week and had physio through the solicitors.
I came out with £2500 in the end bud

how much do people think the payment will be?
will it be more or less than after the accident as I have an 'injury' a year after...!

I was once climbing a ladder in the rain at work, in flip-flops. Surprisingly I fell off and hurt my ankle. Claims direct helped me to get £8000 from work's employer's liability insurance...

nice one, that'll pay for someone to pc the car and a bit of cash i the bank!
i thought it was £2-£3k for whiplash?

Whiplash claims (and every other personal injury claims) have been devalued through the number of people claming (honestly and dishonestly).

As an example - My uncle got £6K for punctruing his lung at work, which resulted in 3 weeks in hospital, a few months off work, and is still feeling the effects 9 months on. Most of that was loss of earnings, not compensation as such.

But, a lot of insurance companies are paying people a flat fee of about a grand to stop people claiming for whiplash.

Not aimed at you in anyway - All this claiming is gonna come back to haunt us IMO.

Fair play for not seeing £ signs. Fair enough I say, better in your pockets than theirs.

^ i never claimed because i know it just goes straight back onto my insurance policy next year, but like you say better in my pockets considering they have already cleared the money as a personal injury claim even though i never put one in.

i don't intend to, hope im never in the siuation again to have to do it really, although i can understand why people do it, its basically free money for saying your neck aches!

im glad i had a conscience when the accident did happen, but because of the circumstances now im thinking why not have it!

I imagine because it will be on your medical records, and therefore, will be hard to prove that any new whiplash occurred as a result of the most recent accident.

I got hit at 40 mph by some stupid wh0re years ago. Got taken to hospital on a spinal board, as did my 2 passengers as we could not move. Was there having tests for 2 days. I didn't claim as I don't beleive in this sueing (sp?) culture. My mate sat in the back claimed about a year after with one of those 'where theres blame theres a claim' adverts, and got £4000!!!

Pi55ed off aren't the words!! :(

i believe you should 100% claim if there is a genuine injury mate, i didnt because i didnt think there was a problem, still not sure but hey....money is on a plate...

Same - apart from the mate claiming. Someone shrunk my dad's old e-class by about 2 feet by crashing into the back of it (whilst we were stationary) at around 80kmh near Dijon :( Car was only 1 month old at the time lol

There's actually a book with standard tariffs for each injury that's used to barter a lot of settlements. One reason why they don't actually have to be solicitors in the "No win, no fee" practices. All they do is negotiate really. No real legal element involved.

Because you are claiming now for whiplash, you cannot claim it again, EVER. Yes it is free money, i wouldnt claim unless i had a real problem with my back. Yes it is a bit of money, but to be honest i wouldnt want the blackmark over my head.

Having said that, pepsi - I don't think you've done anything wrong - just made the best out of an unexpected situation. Fair play to you.

Yet we also end up with situations like what Taylor says. She comes off the worst (by a drunk) and gets feck all where others rake it in.

Imo, the entire claims procedure needs addressing. People are taking the p1ss out of it and pushing up the premiums for everyone else that pays money legitimately into the 'system'.

If I could find the person(s) who kick-started the whole Blame & Claim culture, I'd smack them hard with a heavy, blunt object. Repeatedly. And then some more.
