I was under the impression the car will fail the MOT if its manufactured to have a 3rd brake light and now doesnt / isnt working. So if it fails its MOT i suppose technically that makes it illegal?

Any car is not required to have a 3rd brakelight wether it was manufactured with one or not. Mot wise if there is one their/ a red lens the light must work but you can either remove bulb and spray lens black and it will pass, so if your new spoiler doesn't have one fitted at all then that's fine just make sure your 2 rear brake lights are always working.

you only need two brake lights, indicators, normal lights and a fog light on the rear.
You dont even need a reverse light (unless its there) My peugeot never had a reversing light and went though MOT's for years...

  soon to be 182 ;)
isnt it generally the case that if it isnt there they cant test it? and some cars come standard without one?
