  Land Rover
So l had a few jobs done on my Clio 182 (including a gearbox overhaul) at a well known specialist.
Sadly the gearbox developed a fault after a few hundred miles.
I took it back, the specialist has been great they said just bring it back.
The thing is, they sent the gearbox to someone else for repair and while that company has agreed to fix the fault they won’t pay the specialist to remove and refit it.
Should the gearbox company pay for removal/refitting? Eight hours labour apparently as the car has to be reassembled to get it off the ramp while they wait for the gearbox to come back.
I have to say that in my trade if l fit a part that fails, although l can send it back, it’s down to me to take the part out and refit the new one.
The specialist has said they won’t charge me for the work but he thought the gearbox reconditioners should be liable.

He says he’s used them many times and this is the first faulty unit they’ve had.

I would not field any costs for a faulty repair like that. The garage subcontracted the work out by choice so the cost of labour is theirs to argue over with the gearbox subcontractor.

You won't be charged but they should speak to Agency to get some sort of compensation, maybe in the form of a free rebuild or something next time.

You paid the garage for the job so you're alrite.

Had you supplied the garage with the rebuilt box to fit then you would be liable for costs.

Garage would still be liable. If you fit parts you are deeming them fit for purpose. Doesn't matter where they came from or new or used parts either.

The destination of the gearbox repair was discussed with the owner and based on experience and feedback the gearbox specialist used was a sound bet on price and quality of repair. As a business the who, what's and why's isn't important to us as the key objective is to get the car in a roadworthy state in the quickest way possible to eliminate disruption to the customers life. The box is ready for the courier and we will go from there, we certainly don't expect the customer to pay a penny for what is being done, just slightly annoyed that we are footing the labour costs for a part that has done only 460 miles. You live and you learn.

I did say that Birchdown have been great and are not charging me for the work.
But Agency should in my opinion shoulder at least some of the cost particularly as Birchdown use them regularly.
A whole day’s labour for nothing is no fun when you are in business.
I think that Agency have so far agreed to pay the courier costs but that’s all.
I am also self employed so l know what it’s like.

When I first started out in 2009 / 10 I used to drive all the way from Kent to malpas to use birchdown - one of the best specialist out there -

But as you say you live & learn -
I had exactly the same with a replacment gearbox where ANother specialist replaced a 200 gearbox & gave choice on clutch but never changed the slave cylinder -
9 miles down the road the slave cylinder shat itself & I ended up paying another £400 labour & £100 for the part-

In this situation if Agency were recommended & in reality it was shared agreement then for all intensive purposes the accountability sits with everyone - but good luck getting a penny out of the third party - all the need to say was your the faults developed due to age & its unrelated to a rebuild & your shafted

so you then end up footing the bill yourself or if the garage are decent ( like Birchdown ) you end up with a discount rate-

FWIW the same has happened many times with rebuilt trophy suspension from BG motorsport where the suspension starts leaking again quite quickly after rebuild - BG arent interested in paying your costs for removal & refitting again...

Chalk it up to experience & be grateful your dealing with a decent specialist....

Yes Birchdown have shown their true colours here and that can only be good for their reputation.
The car had only done 500 miles since the repair and 120 of those was driving to and from Birchdown.
The car hasn’t even been driven fast, l did once use the acceleration away from the lights, even then not excessively, and l got such a bollocking from my missus that l never did it again

Well the gearbox has gone back to Agency. They thought it may be possible to just remove the end cap to get to fifth gear, but sadly not.
Let’s see what Agency say is the problem with it.
It never had a synchro issue it was just the whine at 30mph.

Agency have said they can’t actually see anything wrong inside the gearbox so have replaced “everything” connected with fifth gear.
Let’s hope that includes the plastic oil feed. But l’m sure they know what they are doing. Birchdown said it’s the first one that’s given any problems.
