Reversed into, insurance trying to shaft him

This happened to a mate of mine and he's getting properly f*cked about, I said I'd ask on here, this is the info he sent me.

Prima insurance
I have dashcam footage that proves beyond doubt that I was not at fault. Prima are refusing to contact the other party and are trying to force me into making a claim on my policy and I will have to pay the excess.
They then want to get a quote for the damage in the car which will be paid for by my own insurance policy.
Only then will they contact the other drivers insurance and ask them if they are willing to admit they are at fault and then try to claim the money back.
They also tried to push me into using a company called BD Elite who are a third party claim management company who were trying to get me to sign a credit agreement and I still don’t know what that credit agreement was for.

I am shocked by the behaviour of the company and I am deeply worried how this is going to unfold.
As if having an accident isn’t stressful enough I now don’t trust the insurance company who are meant to be helping me.

They have contacted me directly to discuss this review but the woman didn’t seem to understand what the problem is. It seems that unless you are claiming on your own policy they want very little to do with helping you which is why they push you towards BD Elite, so anyone who has a no fault accident will get little to no help. I hope they do the right thing but I still don’t trust them.

The complaints team have confirmed that Prima do not get involved with non fault claims unless you are willing to to put the claim through your own insurance. They will ask the claims department if they are willing to but I’m sure that they will deny my request as it’s not company policy. I now await their email confirming my complaint but as they are standing by their behaviour the complaint isn’t going to go very far.

Wow. That’s f**king mental!

If he has admission of the other driver, I’d just go to a completely independent claims company and let them deal with it. They’ll stick him in a hire car for the entirety and will bill the third parties insurance company. Which is how they earn their money. And they earn a lot of money.

I’ve used one myself as I had a trade policy and didn’t need the aggro of it all. Just because some bellend wasn’t watching where he was going. Worked out perfect.

Head straight to the lorry’s insurance co. It’s in their interest to resolve the matter swiftly as possible to keep their costs down.

Don’t involve anyone else..

Job jobbed.

If this is not the sole purpose for having a decent dash cam I don’t know what is!

Surely he needs to speak to the insurance ombudsman. He should 100% not be signing any form of credit agreement - f**k that, assume it will be for a hire car.

He is also able to pursue this as a civil matter, he can fill out a V888/2A form which will give him the name and address of the registered keeper (although, lets assume thats clearly Turners). From there he can apply to make a court claim. He will need to get some quotes for repair of the vehicle so that he can put a value to the damages he is seeking.

If he wins the case (which he will) he can claim back his court costs which should be sub £500.

Edit* as Dan has said he can also use a 3rd party claims handler which is likely all his BS insurance company would use anyway. A quick google brings up lots of hits for these vampires.

He's my labourer at work, his dog was Eriks best mate and he has brain injuries from getting ran over at 18, so anything stressful like this can actually be dangerous for him.

All this advice is exactly what he needs to hear, i'll get copy and pasting so he's got a couple of next moves.

He just said :

I’ve spoke to them and they were sound to be honest. It’s my insurer that are the problem. I’m gonna talk to them again and explain that I’ll probs have to screw them with a claims management company to get it sorted as my own insurance don’t give a f*ck.

Just my two pence, but echoing what @Sash has suggested I would 100% forget about trying to claim via his own insurance and go straight to theirs. I did this many years back when a neighbour hit my Golf by somehow driving across my drive (pretty sure I posted on here about it at the time). Luckily for me it was an easy, painless process that also allowed me to get two wheel refurbed for nothing as the body shop guy was friendly.

Whilst this is going on, I would see how far he can get via the complaints route with his own insurance, then once they have provided their final response, straight to the Ombudsmen. I've had to deal with them twice now, one for my car theft (again, posted on here) and once for a bank scam. On both occasions I've found them to be very thorough and have put things right. Given the blatant evidence he has, it should be pretty black and white.
