Drivers seat not locking back after using lever

Right, I've done some searching and can't find anything that relates to the issue i'm having with my drivers seat.

Basically after using the lever to get into the back, it sits back up but the rails don't seem to click into place at any point.

After do a bit of investigating it seems there is a small fork behind the cover closest to the door that doesn't go back down to lock unless it is pushed but I have no idea what is causing it.

I've checked the passenger seat and it does exactly the same mechanically but as the seat is pushed back the fork automatically clicks down and locks.

I'll try and get some pics of the part I mean when it stops bloody raining, but does anyone know what could cause this?

Couldn't get my head around this issue and have resorted to not using that side to get in the back and all was fine until today, apparently its an MOT fail!!!

I don't understand why because it still clicks back into place with some help -_-

Can anybody shed some light on this problem, need to fix it ASAP because my MOT has expired :/ I'll get a picture up tonight if that helps!
