Imprtnt question about speed cameras

My mate recently got a letter thru about being caught for speeding down wickham way for those of u who mite know. They say they have photographic evidence, but there isnt a speed camera down that road.

how has he been caught, could it have been an under cover white van? wot kinda rights has he got, is the best he can is ask to see the pics?

would very much appreciate your input guys and let this be a warnin to us. there doesnt have to be a speed camera to get caught!!!

Can you not ask for a copy of the picture? You could say youre not sure who was driving at the time and need it to check.

ive told him to request a picture, but im jus shocked that hes been caught, i mean i ddnt realise they wud start using mobile vans with cameras in residential areas such as that! i thought they wud be more in use on the motorway or suchlike.

its really given me a shock cos it shows how easy it is to get caught!

ive passed on the website to him, bt is there any other device he cud have been caught on that takes pictures?!

cheers for ur help!

You need to watch out for timing cameras they look like cctv cameras but they take your picture and record what time you went past the camera at then they take your picture at a second camera further down the road and record the time again then they compare the times and thats how they can get you for speeding. From what I know these things arent 100% legal and they shouldnt be using them yet but if they have a picture of his fcae tell him to the coppers thats an invasion of privacy under European Law.

Not AFAIK. The police tried to bluff people by quoting a similar case recently as proof that the loophole is closed. It has not been though. They are just bluffing and dont know the law too well themselves. There is NO requirement at present to sign the statement of driver identity although there IS a legal requirement to supply the information to the best of your knowledge. Im in the middle of a legal wrangle over this at the moment as I refuse to sign a statement that I know to be false - eg. I am pleading not guilty to a speeding charge and have already said I will not accept any offer of a fixed penalty. Therefore if the CPS intend to pursue the case, it will go to court, where a signed statement of guilt will go against a not guilty plea. It is my right to plea not guilty unless they have evidence beyond reasonable doubt that I committed the alleged offence. Which to my knowledge they do not have, and if they do, it is also my right to see their evidence before the court date.
