thanks to business link for hiting my car

  H22A7 Accord Type R

well, my car, which lasted new for 1yr and half, had its first incident today! Driving down to a give way onto a back street with cars parked along the right hand side (from my driving position......on OTHER guys side of the road), a guy flashes me out (he was slowing) so i pull out onto MY CLEAR side of the road, and along comes a SMART CAR on MY side of the road (due to parked cars) at a fair speed. So, i slowly move up the road, and slow to a standstill, opposite a gap in the parked cars for him to pull in and let me continue. OOOOOOHHHHH no............ not only did he not pull into this gap, he also decided not to EVEN TRY and steer the MERC through the gap between me and the parked cars....HE AIMED for my car! Now, this smart was left hand drive, meaning he was closer to the side of the parked cars, meaning he could judge it well. now my witness.....who let me out, said he had plenty room between me and the parked cars anyway......so why did he not use this room i ask????

So, having not got his name, and him leaving, saying, ill come back in 5, have to go to post office before it closes, i went down to the depot to tell them the story. The nice friendly and helpful lady took all my details and said to get a quote to her and they will sort it! I advised her it will be going to renault, as it is still under warranty!

Sorry for being vague, i still havent got my head around this, and need advice as to what to do. The police say i have done it all the right way, gettin company details etc (i feel stupid for not getting his name in the heat of the moment! he was very rude, abrupt, with the attitude of- haha my company car, i dont care, ha ha). So what would u lot advise???

monday - im off to Renalt and a good company i know well ;) to get some quotes. I have never dealt with anything like this before so am really unsure! My dad (who is on holiday) advises me to get my insurance involved. Now this was no way my fault (me stationary, him barging through n hitting me) so if i involve my insurace, my no claims wont be effected will it??? it means the world to me at my age!!! Please help guys!! should i ring my insurance tomorrow????

As for the guy, he didnt stop straight away, he parked up down a side street and waited for me to FIND him! no apology, no coming to see what had happened, i had to find him n go up to him!! mr arrogant also! BUT I DIDNT GET HIS NAME....ONLY REGISTRATION :( my stupidity!

So guys, please advise what you think i shoud do?! its not a nice thought that someone driving a company car thinks he can drive like this!!!! Maybe he just wanted to hiy my mirror????

The damage.......drivers side......front bumper scuffed, and bent in where it meets the wing

Drivers wing scratches and looks like paint is cracked (with it being flexible plastic)

Mirror marked........im sure the mirror and bumper will polish up ok....but the wind may need re-sprayed!

the best bit........alloy nackered.....spokes have been done by his tyre and steel wheels going across the front of them......and the car goes to the right when steering straight!!!! im hoping this will just be tracking....£40 to have re-lazer tracked!! I am going to have reno have a good look at this, i dont want any driveshaft issues or anything....it has to be right!!!!

Pics....... go to http://groups.msn.com/robsclio16vdynamique/thebump.msnwhttp://groups.msn.com/robsclio16vdynamique/thebump.msnw

leave any info u can guys, need some help! surely they should pay for a courtest car too??? if not, i could always send a nice letter to business force head office!?!?

cheers all, a very gutted Rob

rob, if he accepts he is to blame his insurers will probably offer to repair your car for you and you will get a courtesy car, call your own insurers to advise them of the accident and give them the reg number, they will access the motor insurer database and that will confirm the insurers of the company, call them with the policy number and get it sorted out.

if you need any help at all please let me know as i deal with this sort of crap day in

if they say they will pay it then just get a quote for all the work, tacking, new suspension, whatever it takes then bill em for it, they will prob give u a cheque then get the work done.

if they do it like that your insurance knows nothing about it.

if it has to go through insurance then so be it but they may have it inspected meaning some of the bits u potentially could have had sorted maybe declined.

also will it not be registered your cars been in a prang?

im not 100% on the above info but thats the way i see it

unless the car is a write off it wont be registered as having been in an accident

where did it happen mate??? Be careful wich dealership you use, Dont used Arnold Clark in Wigan, work is poor. Dutton James in St helens are superb, BRUN will agree. Judging by the pics your wing should be ok if its stayed together on the fiting points, the arch liner has broke as you can see. Does your headlamp move as these break easily as they have plasitc fittings to the front beheing the bumper.

This is almost identical to when a taxi brushed my front corner it was just closer to the corner.

be sure to make clear with your insurance claim that the other driver admitted full responsibility at the scene....small thin but it goes a long way cos he could otherwise try and shift some of the blame one you and bang goes your no claims!

...the guy hardly said two words before driving off!!!! dont see how i can be to blame if my side of the road is clear, i have stopped opposite a space on his side with the parked cars for him to pull into, and he ignored it and went straight into me on MY side??? and i have a witness to prove that!

Cant wait till monday for a quote!!!! If they pay me off, all is well, depends really on how much damage has been done by hitting the wheel!! i hope its only tracking! With the car being silver, the little scratches are hard to see! but the wheel is well fooked!!

ok mate. im new but my advise....

all you have to do is say you were stationary, with your foot on the brake pedal! u cant lose your NCB bonus! u dont have to pay excess if u have it! this is wot i was advised by my solictor when some old bloke drove right into the back of me.

you will have no probs, just remeber u were stationary, also to hurry up the process get a solictor involved! ring the DAS, they will assign u one if u dont want to get your own solictor involoved. also if they havnt paid up / go the work done iwithin 2 months, ring up his insurance company and tell them u are taking the gentlemen to court, as he has coursed blah blah blah, detress, loss of use of own vechile, really lay the sh*t on thick. they will pay up straight away.

another fact....... dont worry about hte quailty of the work that will be done on your vehicle, becuase once the work is one (repaired) u have to sign a bit of paper that says the work insurance repaire has been satisfactory (this is by law they ahve to do this) so take your car bak to renault, get them to look over it first, only sign it if they believe that any work done, will not effect your warrenty.

i think most of what i said is accruate?!?! its all off the top of my head, and after a nights work. everything is from personally experience and wot my solictor informed me to do.

sorry to hear mate :( I know exactly how you feel. I had my car hit the other weeks. Do everything you can to cover your own arse!. My recent encounter was a woman running a red light and hitting my car. At the scene, she admitted it was her fault. A week later I hear that she is denying it! I am lucky i got the police involed and have a solicitor as a witness! situations can change very easily. I hope you get the result you want!

:(gutted, thankfully the damage isnt too serious but i know how you must feel, its horrible when your pride and joy takes a knock no matter how serious. hope you get it all sorted quickly mate

sorry to here bout ur bump mate.

u wanna explain to Business Post that its illegal to leave the scene of an accident without giving details to anyone who has reasonable right to have them ie you. You can say the Guys attitude (got to get to P/Office only got 5 mins) was probably the cause of the accident, was he rushing?

I would stick this in a letter to the company, perhaps suggesting that they put their drivers under too much pressure, and as a result are putting the general public at risk. Send it to the Managing Director marked Private and confidential - At least the bloke involved will get a right 8ollocking.

Good Luck!

Smart New Priority Service from Business Post

Local businesses can now be sure that priority documents will reach their destination on time, thanks to the launch of a new service from Business Post.

Barry Andrews, who has the Business Post franchise for Wakefield, Huddersfield and Halifax, has just taken delivery of a new Smart car and the eye-catching little vehicle is already zipping round the area, collecting and delivering priority items for local companies.

Barry is shown handing over the keys of the Smart car to Business Post sales representative, Howard Clements and comments:

"There are many occasions when a business wont want to trust an important letter or document to the postal system.

"When a guaranteed delivery time is essential, it doesnt make sense to leave things to chance.

"Now, any company with a WF, HD or HX postcode can use our service, safe in the knowledge that important items will be delivered door-to-door within a guaranteed time scale.

"Its definitely the SMART-er way to do things! "
