They are usually new mate. They are just not retail units (ie just a phone, without a charger,box etc)AFAIK anyway

That's the problem my mates having, he bought a 5 last month and its having lock button problems, but if the 3 month thing is true, it could be useless. Don't take what I'm saying for gospel, this is what they said to my mate when he took his broken 4 in last year.

As dan said, book a genius appointment (not always needed, but anytime iv gone iv needed one), tell them what's wrong, if its intermittent tell them that. They will run tests on it, and will swap it for a new one with 3 months warranty.
