I have recently received a text from yourselves informing me that you are changing your policy regarding calling 0844 & 0845 numbers, I understand that these will no longer be included in my X-Network minutes, instead I will be charged @ 20p per minute, from the 28th Sept 07.
This clearly constitutes a change to my contract which will have a detrimental effect on my monthly billing.
Term 8.4c of my contract states:
8.4 You may end this Agreement by giving us written notice if:
(a) We break this Agreement in any way and we do not correct the situation within 7 days of your request;
(b) We go into liquidation or a Receiver is appointed over our assets; or
(c) We increase Charges for your Inclusive Calls or your monthly line rental charge or change this Agreement to your significant disadvantage, provided you give us a minimum of 30 days written notice (and provided you notify us within one month of our telling you about the changes). This does not apply where the increase or change relates solely to Additional Services in which case you may cancel.
The above was taken directly from my terms of contract, section 8.4c.
As I am writing this within 30 days of your notice, I am clearly within my rights to cancel my contract.
However, I have been an O2 customer for several years now on pay as you go and in recent years have upgraded to pay monthly & up to now have been more than satisfied with the level of service provided.
Please therefore acknowledge my official complaint & propose in writing a mutually agreeable solution to this O2 created problem, otherwise I will have no option other than to cancel my contract on the above grounds.
I have requested a read receipt on this email to acknowledge receipt and have saved a copy for my records/subsequent contract debate.
