02 contract cancelation because of new charges

Anyone know how to cancel their 02 contract because of the new 0845 charges? Or which part of the contract it voids?

Just had a text from 02:

According to their t+c's:

8.4 (c)you are a Consumer Customer and we increase charges for calls, messages or data that form part of your inclusive allowance or your Line Rental Charges or change this Agreement to your significant disadvantage in accordance with paragraph 9.2 of the General Terms, provided you give us a minimum of 30 days’ written notice (and provided you notify us within one month of our telling you about the changes). This does not apply where the increase or change relates solely to Additional Services in which case you may cancel, or stop using, that Additional Service.


Basically, you have 1 month to write them and cancel your contract. This is of course for people who took out their contract pre 27 April 2007.

Woo that me, i'm going to cancel then take out a brand new one with them lol.

i know i've made a few calls to those numbers. In my email (disconnetions242@o2.com) i said i choose o2 specifically becausse I am moving to a uni house without a landline in October and will be calling them more frequently


But.....

they are so annoying.. telling me id only made three calls in the last month.. thats still usage. he is issueing my pac code but he said i will get a termination fee of £550 and i have to call to make sure they credit my account.

Anyone know any good deals - i am gonna get a new phone and contact tommorow

if so just call O2 on 0870 600 3009 instead of your short number from your handset a few times lol

They can't charge you a termination fee. The t&c clearly state that you have the right to cancel, they do not stipulate any useage condition to qualify for this. You entered into a contract which allowed you to call these numbers, using them or not makes no difference, o2 have changed this contract.

02 have now started to charge you for 0845 number, so they are in breach of the T&C's so you can cancel the contract (keeping the handest) at no cost.

Dear Sir or Madam:

I have recently received a text from yourselves informing me that you are changing your policy regarding calling 0844 & 0845 numbers, I understand that these will no longer be included in my X-Network minutes, instead I will be charged @ 20p per minute, from the 28th Sept 07.

This clearly constitutes a change to my contract which will have a detrimental effect on my monthly billing.

Term 8.4c of my contract states:

8.4 You may end this Agreement by giving us written notice if:
(a) We break this Agreement in any way and we do not correct the situation within 7 days of your request;
(b) We go into liquidation or a Receiver is appointed over our assets; or
(c) We increase Charges for your Inclusive Calls or your monthly line rental charge or change this Agreement to your significant disadvantage, provided you give us a minimum of 30 days written notice (and provided you notify us within one month of our telling you about the changes). This does not apply where the increase or change relates solely to Additional Services in which case you may cancel.

The above was taken directly from my terms of contract, section 8.4c.

As I am writing this within 30 days of your notice, I am clearly within my rights to cancel my contract.

However, I have been an O2 customer for several years now on pay as you go and in recent years have upgraded to pay monthly & up to now have been more than satisfied with the level of service provided.

Please therefore acknowledge my official complaint & propose in writing a mutually agreeable solution to this O2 created problem, otherwise I will have no option other than to cancel my contract on the above grounds.

I have requested a read receipt on this email to acknowledge receipt and have saved a copy for my records/subsequent contract debate.

02 was the last mobile company to offer free calls to 0845 numbers.

still the point imo is...if i want to break the contract normally they would screw me....they have broken the contract so why shouldnt i return the favour?

Because you signed a contract saying you wouldn't, they didn't.

phoned o2, they offered me the following -

Cancel free of charge

keep my 500 mins/txts but only pay £25

or go on sim only deal

i opted for the reduction on my tariff, gf pays £35 for 400 mins/500 txts so im getting quite a good deal really

does any1 know any way for me to cancel my t-mobile contract, im off to uni which wasnt planned and i have 9 months of 18 month contract left to run!

02 just wrang decided to stay with them £15 a month for 200 mines and 400 texts, will do me, and i'm only on a 30 day contract woo.

Don't you have to give 30 days notice? If so they are going to screw you over when they try to take their final payment! Especially as you don't pay for a months use until the start of the next month.

I'd tried to un-cancel your DD if I were you.

just cancelled mine, forgot about this oops but still in the 30 days. Think I'll go on this £15 sim only deal and see what phones catch my eye. The K810 looks no bad tho
