5C issue

Ok short story.

take out contract in 2009 with insurance from phones 4 u (policy admin)
sell phone (blackberry) for iPhone 4s
sell 4s buy 5
5 gets completely obliterated
I claim off insurance
i sent it lasts friday, I had an email Saturday saying its been accepted
get a phonecall Mondays, they will have to order a 5 for me will take up to 5 days will probably be an apple recon unit.
or I can chose a 5c and have it within 2 days.
i chose a 5c, I receive it the next morning (impressive)

5c is brand new sealed in the box
5c restarts all the time
5c took 4 attempts do reinstall an iCloud backup from my previous 5

what do I do?

do I ring the insurance and send the phone off to them costing me another £7 in postage and be without a phone for x days?

or

because it was a brand new item, can I go to apple and get it swapped there and then?

I thought I could get away with that but wasn't sure. I'd have to ring the insurance anyway and update my Imei number

Score - phone had 359 days of warranty so if here is any issue with it they will just change it :)
