Advice regarding R3OBC story.....

Hi all......remember me? lol

Those of you that will remember my incident in July, 2005.........where i hit a huge unmarked ramp on a country road, and done my wee clio some damage.........will remember that my quality insurance company - elephant - sent out an engineer to assess the damage, and reported back that he thought i was lying about some of the damage, stating that it was 'not consistent with the accident' etc etc.........anyway, the guy was a pleb and knew nothing.

To cut the long story short, i have been battling with the insurance about this! why should i have to pay when i have already paid a pretty substancial insurance premium...........I fought, and fought, 8 months my car has been off the road.........and in the last few weeks, i got my evidence from another engineer, and sent in an official letter of complaint, threatening with the ombudsman!!! Before i knew it, my repairs were authorised and i was being constantly updated by Elephant!!! (for the first time through this whole claim).

So, the car will be back soon (apex struts on back order), BUT, my next question.............obviously i am going for compo!!! 8 months, no clio, no courtesy car, no MOT / TAX and an insurance renewal pending as soon as it returns to me................a QUALITY MANAGER (LOL) rang me today........stating that she had reviewed the case, and it was indeed unacceptable........blah blah, so i was laying it on thick! She agreed to waiver half my excess, bringing that down to £200........she could tell i still wasnt impressed so within 2 minutes waivered the whole £400 of my excess (just leaves me £70ish to pay to bodyshop - price difference for apex struts over standard ones). I told her i wasnt willing to accept this as a final settlement, and asked her to send me it in writing so i can go back through my history and have a good think about it.

So guys, i need some opinions...........i have been without my car for 8 months, depreciation will have had an effect, ive lost 8 months of tax / mot / pre-paid insurance.........i had to buy a £450 mondeo (and spent £300 on servicing and parts), Lots of £££ for temporary insurance......... as it stands, im being offered £400 as compensation........am i right in thinkin i should be pushing for more. I really do get the impression she doesnt want this going to the ombudsman!!

Advice please guys........my thoughts are to add up all my temporary insurance costs, and hit them with those too...........should i add the mondeo costs and ask them to come to some sort of compromise?????

mate, what a nightmare! :( i would definitely ask for more, at least as much as it cost you to buy and service the mondeo.

Glad to hear it's getting sorted,are you going to re-insure with them?If so I would be asking for a years free insurance at least.
They should be offering you more in compo than just waiving the excess,don't know how much though.Have you tried the citizens advice bureau?

Take what you are offered...IMO.

(was it yourself that hadn't reported the fact that the car had been modified...?)

noooo, my mods are always declared!!! It was their appointed engineer that doesnt even know what a bent strut looks like!

I dont really agree with the 'take what im offered' either.........i gave them my money to insure my car, i had an accident and they done everything they could to get out of paying to repair it!!??

yep don't agree either R3, ask for more. I don't think you can ask for the cost of the mondeo though, as you own it or can sell it.

he already has, first offer was £200, they are just offering his excess back. Sh*t deal in my opinion, but i think he knows that too.
 
Alright mate,id bang the mondeo costs on your "i want back" list along with the extra insurance u paid,really u should have had a courtesy car supplied with their insurance so try and get that back too...hope to see ya soon matey,

mondeo is already sold LOL!!!! Nah no breakdown of the £400......she just bumped it up to that when she realised i wasnt impressed with the 'half the excess' comment. I'm going to need to have a think...........you know what would be really nice........to actually be cleared of all insurance claims hovering over my head!!! since my silver clio in Ma 2004, ive had a claim over my head, now this one.......once i get this cleared, touch wood.........no hassles!!.........till next time lol

*excess is £400 btw guys.

IMO, go for everything else you have said, deduct what you got for the mondeo from what you paid for it and add that to the list.
 
I think I'd be tempted to ask for more. What can they say? No?

You've been put out by £750 + extra insurance by the sound of it so suggest that they pay that..

Or maybe ask for an MOT to be included in the repairs (will only cost them £35 or whatever it is) and for them to extend your current insurance for 8 months at no extra cost to cover the time your car has been off the road and you've not been using the insurance. And tell them that you'll accept the waiver of your excess as an apology for the trouble caused by their incompentance....

i will state that i bought it.........then just put down for servicing / running costs, as i had to take the mondeo from Leeds to Isle of Skye on holiday lol!!! (it was actually a f****** brilliant car to do the trip in too!!)

Not a bad view Robert! if i do insure with them again, im sure i will make them aware of who i am, and wont be expecting any of this crap again - the woman told me it really is not usual for this to happen lol!! Plus, ive got them looking into their 'engineer'. good cause he is a total toss pot and i hope nobody has to deal with him or his company! apparently, they are well known in the trade for basically trying to throw claims out!

The poicy does not cover replacement of uprated / modified parts.....im paying my bodyshop the difference to get my own specified parts supplied and fitted.

my brother took direct line to the financial ombusdsman when he got his 330ci stolen (they even interviewed him as they thought it was suspicious, it was the usually keys tolen from the house). They ended up offerering £14000 minus £350 excess and he argued for months with them and it went to the ombudsman and they eventually decided that direct line should pay him £15,000 so he ended up with £14,750 and that was a thousand pound better than their initial offer.

I would seriosuly consider going down this route, basically as you said elephant have done everything then can to get out of paying out, so the ombudsman should take them apart. This is so typical of insurance companies quick to take your premium not so quick to pay up

i had this with privilege recently. Financial obudsmen recommended amount is £10 per working day as a compensation guidline!!! Privilege told me that themselves!!

I would go for a hell of a lot more Rob - take into account everything. Send them a detailed bill of how not having your car has meant buying another car, the inconvenience caused in all of this etc etc.
Elephant (touch wood) have been good with my claim so far, but getting my excess back looks like it could take some time. The way they and especially that engineer treated you was absolutely shocking tho

push for more.. £400 is not a lot really, esp. when you think about the 8 months its taken to sort out! You also want that assessor's head on a plate too!! F.kin muppet.
You want what the car was worth 8 months ago, also claim for 8 months tax on a car you couldn't drive.. also try to recoup for the insurance costs for the "hire" car you had to insure.

cheers guys........yea im definately going to take it further! i paid near £900 for that policy, and had 4 months motoring out of it!!..........bargain! its all the hassle more than anything, and the thought of my having a shagged car, and a loan, and........no insurance cover to repair it.........8 months is a lot to go over!!! im glad i stuck with it though, i'm in the winning seat now, i have the evidence.....i need to speak to the ombudsman! :D

thought about it Si.......but, ive just been awarded my 3yrs no claims back from my silver clio..........so.......that knocks an elephant quote down to £550ish lol!!! (they have had the cheek to send me a renewal out at £1000 lol.......obviously they dont know i have 3yrs no claims bonus now)

so many options.............lol lol!!! will prob run it for another year, try my hardest to get up to 4yrs no claims (and protect!!! - never thought i would see the day).........then chop it in for something faster!! ;) Use the van for a year, just use the clio at weekends :D

In which case mate, 8 months x £10 a day = next years premium with someone else + money to fix any minor niggles on the car so you can sell it and more up the ladder :D

Mission accomplished.

Fecking insurance companies f**k me off.

I seem to recall informing you to contact the ombudsman about erm 7 months ago lol, if only you had of done then this would have all been sorted.

Iv just checked our policy booklet ( UK insurance i.e Tesco, Direct line ) if we are unable to provide customers with a courtesy car, in other words they have no method of transport except pesant wagons, we pay up to £15 a day until the claim is paid out.

This seems a reasonable amount to request .

yea but it took my engineer some time to get his report done and through to me. as soon as i had my report, and had hard evidence that i am right - the evidence which Elephant asked for.........THEN i could issue them with my official letter of complaint. Yes, a lot of the time was due to me waiting for MY engineer BUT...........his report got referred to Elephants original assessor to authorise anyway.........which he did in the end.....so IMO, why didnt he work it all out in the first place ;)

**UPDATE**
THE END!!! im sooo damn happy to have reached this stage after all the crap!! okay, car should be back soon, still waiting on apex struts coming in. As you know me £400 excess has been waived.....i responded to the quality managers letter quoting my £445 mondeo cost, £315 servicing costs and £120 worth of temporary insurance costs. She got straight back to me today saying they will pay for all of the above, and a cheque for £880 will be sent out to me as soon as i get her a cop of the receipts over :) so, £1280 all in when you include the excess. Claim done with (okay, so they may chase the roadworks company after all this time? lol). I'm happy with that, and for the first time since May 2004 - i no longer have an insurance claim hovering above my head!

Touch wood and..............roll on a 172 perhaps! I truly never thought i would see the day! :D
