Legal Advice Needed - PLEASE HELP

This is kinda serious, if anyone can tell me where i stand ill be most happy.



Sometime in May I was driving home from work and I got caught in traffic Jam on a duel carriageway (as you do from time - time). Anyway in the corner of my eye I noticed (from my wing mirror) an Audi A8 driving like a nutter coming down the central reservation!!! He was doing this as an attempt to skip traffic I guess. Anyway, as he is coming down at high speed, he has 2 wheels on the motorway and the other 2 on the reservation! I tried to move out the way as he came down so not to be hit along side my drivers side, but I couldn’t. I was boxed in and had to just watch as he came closer and closer..



Anyway he drove past and just missed my wing mirror by about half inch – I was so happy he didn’t hit me because he wasn’t stopping for nobody, clearly a drunk driver or a joy rider.



Anyway it gets better!!



Traffic starts to move, as I’m crawling along I see some bird (about 6 cars back) start wring my number plate?! I’m thinking what the hell she doing? Maybe she wants me as a witness – fair play to her, I’d give a statement.



5 mins later after moving half a mile in traffic things come to a stand still. The next minute I know – this bird who wrote down my number plate is knocking at my window!! Shes foreign! – Conversation went something like this



Crazy women – “you give me driving license, I want number”

Me – *undoing my window* “are you ok? Whats wrong?”

Crazy women – “big scratch” long big scratch”

Me – “that audi hit you ? do you need a witness?”

Crazy Women – “pull over, I call the police you hit my car”

Me - “WTF, I hit your car?

Crazy women – yes, I got witness, pull over or I follow you”

Me – “good luck” *doing my window back up*



Drove home in disbelieve, thinking to myself maybe I did hit her? (I started to question myself due to the shock of it all) pulled up to inspect my car – its mint as always, not even a hairline scratch!



Anyway, about 3 weeks later I get a letter from the police saying they want me to fill out a form and send it back (details of where im living etc..) sent it off. Another week later I get a bloody producer!!! For f**k sake!!! Letter is telling me I have been involved in an accident and by law I have to produce my documents in 7 days.



This is getting serious now, I can genuinely say I did not hit her car, if I did I would have stopped. This thing is starting to stress me out alittle now, and would appreciate any advise from anyone who has been in a similar situation to this, as im sure someone has.



And before you start – I don’t have her address so I cant burn her house down.



If i get proved guilty of an offence i didnt do, then this means "ANYONE" can excuse "ANYONE" of a drivng offence by just saying they have a witness - this cant happen can it?

Sounds to me you just need to produce your documents at the Police station...They should be able to explain everything there...Did you get the number of the Audi ??? And was your car the same colour as the Audi ?? Maybe its a simple case of mistaken identity ???

One thing she has to do is describe what happened, so if for example she says you hit her with a wingmirror, you must have wingmirror damage? Id just refuse to pay, ask for proof etc. and if the crazy cow persists get your solicitor involved!

Tell them what you have said here, write it down so you dont forget anything.....I would think it would be up to her to prove it, and not up to you to dis-prove, and as you dont have a mark on your car she has no evidence at all..

This all happend in early May - They may try and say i have had the damaged repaired or something. The problem i have is that she claims she has a witness. its imposable for her to have due to the simple fact i didnt hit her!! She may stand up and say "yes she was hit" but there is no way she can say a clio 16v hit her.

Yeah id like to see what her description of the car is, and the witnesses. Surely if it was this easy to blame someone there would be loads more cases?

This would mean i could note down someones reg and blame them for my damage on the wing, all i need is a mate with me, sounds a bit too easy to me!

Rockport chill mate. Picked up a bit after living with a lawyer for the best part of 25 years.

They have asked you to produce your documents so that in the event of any further claims by this nutter they can say they have actually done something with her accusation.

As she has no witnesses it would rely solely on physical prove beyond doubt, i.e cctv, paint traces between both vehicles, glass fragments etc...

Just take along your documents, explain what happened politely and calmly to the officer explaining how she was foreign and obviously upset and confused and that will be the end of the mater.

How can she have a witness if you didnt hit her. If her car is damaged they will inspect it and find traces of the vehicle that actually left the damage.

Thing is vivj, it may not have been the Audi that hit her. There was also a black golf infront of me. Im begining to think she didnt see the car that hit her - so shes got out, maybe seen a black paint mark scratch on her car then asked a witness, pointed to the golf and mistaked it for my car...

or im just getting over paranoid now?!

Rockport at the end of the day if the police were interested in her original complaint it would not have taken 3 weeks to send out some standard form to you and then a further week to give you a producer.

They probably thought sod this just send him one of those forms and we will give him a producer.

Dont worry.

1. There would be damage to your car if you had done it.

2. Even if the paint on her car is the same colour as yours it wont be *exactly* the same so it wont match.

Dont worry. If they ask you about it just tell the truth.

As I said at the time lad, she doesnt have a leg to stand on, there will have been plenty of reports of damage at the same time from the other drivers involved, and as soon as they meet her - theyll see shes a foreign nutta and hopefully lock her away!

The only thing against you is ur Criminal Record, driving offences and being a dirty Chav

If you are still worried - go speak to a lawyer. If you dont have one already, then most lawyers will give you a first interview free (check this first).

UPDATE :-

ok, just got back from the police station. They took me in a room and took a full statement from me. Police are happy with my story, and are not going to chase it.

By law she has to forward my documents to person involved as means as an attempt to claim on my insurance, lol. HOWEVER - this so called witness was a passenger of hers! do this person cant be used as a witness.

damage consists of 1 broken wing mirror! Which confirms it must have been this audi that hit her. only a case of matching up the paint work now i would have thought, not sure she has a leg to stand on now.

we shall see... (got to call my insurance company now and tell them what happend)

oooh - Id have rather kept the insurance out of it, even though its bugger all to do with you.

I cannot understand why the Police have to forward ur details, even though they are satisfied u were not involved.

You should request her details, as I am sure that EXCHANGE of details is required, sounds abit one sided to me. You could then pay her a visit at home and explain ur side of the story.

Basically the law is there to protect people as well as prosecute them. You cant just go round writing number plates down saying that people have stratched your car. You have no sratches on your car, She has no witnesses. So produce your documents and make sure you dont sign anything that states you did scratch her. Its your word against her so the police can do nothing.

I had a problem very similar to this last July. Some woman said that i hit her in a car park causing a dent in her wing. I had a passenger at the time and we both said nothing happened, i checked my car and there was no sign of and scratch or anything. She rang the plod and they gave her my home address and phone number then her husband was on the phone telling me i owed him £150 for repairs. So i told him to come round mine and he could have it *a kickin* if i did do it. He never turned up but kept on phoning. Then i got a NIP from MR plod so i filled that out and sent it off. Then bout 3 weeks later the cop was round mine taking a statement and checking my details. I then heard nothing for ages till i go a letter from the police saying that they wasnt guna do ne thing as there was no evidence. After that i got a letter from the blokes lawyer saying they were guna claim off me so i sent it onto my insurance and in the end they told the other bloke to sod off. It took about 7.5 months in all to clear up and it was a nightmare for me as i thought i was guna get done by police and get my insurance claimed off but in the end neither happened.

clio_novice - i hope things dont turn up that way for me, i want this all to be over with now. 7months seems a long time.

Thanks to all those that replied. i have contacted my insurance firm and told them everything. We had a big laugh about the whole thing, which was good. I dont think physco women is going to get very far - time will tell, ill keep you posted.
