MOT / Dealeer help

Girlfriends Daewoo Matiz failed it's 1st MOT today as they said both headlights were out of line. Does this seem odd for a 3 year old car with only 7k on the clock (she's had it from new and alwals drived carefully)

Also the dealer failed it, then passed it at the same time 14:35 (we have the 2 slips) then rang us at 3:30 to tell us it had failed and needed the lights doing to pass.

Surely:
1) The level should be covered under the 3 yr warrantee
2) They should not have failed then passed it instantly
3) They certainly should not have passed it until they even asked us if we wanted the work doing.

At the end of the day it was only about £25 so not sure if I'm being picky but don't see why this was not sorted free due to the age and mileage

1) Difficult to argue I'd say just accept it. Could be like that front new or accident damaged the garage MOT guy just checks not his job to find out who's to blame.
2) The MOT guy probably fixed it as part of the MOT without going through the rigmorole of asking ringing you etc etc and fixed it in a few minutes and told someoen later the lights needed doing and he fixed them on the spot.
3) Yep your right the work was done IMO almost instantly as such and you could have refused to pay not like there going to undo the labour they'd just have accepted it and the MOT guy would get a moan at for doing work and the garage not getting paid as such and he shoulnd't be a good samaritain etc. But on the other hand the garage MOT guy saved the phone call to you and the retest which you'd have granted anyway most likly.

If it realy bothers you go see ther MOT tester his/her names on the sheet and ask.
