Need some sort of legal advice...

  172 Cup
Just a quick one really, was going down a dual carriage way about 30 mins ago, when some old dear pulled out into the outside lane, leaving me no room to move at all, I braked, locked up, then she sideswiped my bumper. Once we had pulled over, she suffered the most damage with her rear quarter of the bumper all scuffed etc (nothing a t-cut wouldnt fix) but mine has actually taken paintwork off, so I'm now down to the plastic...

Now, I would go through insurance however, once we had pulled over, about 3 cars went past and a BMW Estate pulled up behind me, I shat myself thinking it was the old 5-Oh, turns out, some equally old man, got out the car and claimed to have saw everything, and tried telling me that I went to pull back in at which point I misjudged the gap and hit the woman, despite it being the total opposite, he was adamant that I was in the wrong!

I gave the lady my insurance details and a contact number, after which I had kindly told the old fart to piss off and mind his own business, but I think she then gave him my details, a bit fishy, but if I go to the insurance and them two say it was my fault I'm screwed!

How hard is it to a) spray a small area about 3inches long by no more than a 1cm high? b) what the hell do I do about this insurance malarkey?

Cheers,
Chris

Shes an old lady, therefore she will most likely go through insurance as usually ( not being too stereotypical) they dont have a clue about doing it any other way.

Who was in the wrong (honestly) ?

How old are you ?

What was she driving ?

Your description of how the accident happened doesn't make sense to me. If she pulled out infront of you how did she sideswipe your bumper?

A bit of a better explanation may be needed. However, I'd say if there is a witness then it will go down as your fault.

Because M3's and old people don't mix lol ;)

I read it as he was in the outside lane, she pulled out without looking. Despite him braking and taking avoiding action, her rear corner hit his front left?

Why did you sh*t yourself thinking it was the old 5-Oh?
It's a tough one this. It's a 50/50 at best for you I'd say unless she is VERY honest. If the witness suggests she indicated, pulled neatly into the lane and you (effectively) rear-ended her, it's your fault I'm afraid. How did she react after the incident (did she think she was in the "right" so to speak)?
Also, when you say "with her rear quarter of the bumper all scuffed etc", do you mean rear quarter AND the bumper?
If she needs work to her car (which she will) she will most likely tell her insurer her side of the story and you may be asked for your version of the events and the insurers will deal with it between themselves. In that case, you should tell your insurer. In future, you WILL have to disclose that you have been involved in an accident.
If circumstances permit (i.e. you manage to speak to her and she agrees), you might offer to pay for the damage and avoid the insurers but you should still disclose that you were involved in an incident but no claim was made.

Correct, sorry I didn't mean sideswipe more like touch/rub etc. I'm 21, she was in the wrong, she pulled out, no indication, didn't look, it was wet and I braked when she started to move out, she did it quickly, I assume to get into the small space there was between me and the car infront.

is1 I mean her bumper, she was driving a BMW 120d, the bumper does round quite far is all.

I crapped myself about the cops becuase they have a nasty habit of where I am to nit pick, tug you for ponsy things. Just arseholes in general to be honest, would rather have not had them poking around the car and myself, got nothing to hide or nothing wrong with the car, just the hassle.

is1, she apologised for pulling out, she was shaken up and in shock a little bit, she admitted that she didn't leave enough space, it's just this other t**t I'm worried about...

That's really handy and changes my view TBH. The point is, she could have made it very difficult for you but it seems she accepts she was in the wrong.
Have you got her contact details then? You need to understand where this is going because as it stands, you are entitled to ask her insurer to pay for your repair and a car while it's being done.
You also want to let the insurers (both probably) know what she said after the incident in your statement.

Yeah I mean it was handy that she admitted, but I'm still concerned about this bloke who appeared out of nowhere, claiming he saw everything, from like 3/4 cars back and says it was my fault, despite she admitting it infront of him. Just write him off as a ****

Lol it will look pretty suspect if you have witnesses from Stoke and Bournemouth all driving ClioSports for an accident in Cambridge.... but you already knew that ;)
