i travelled 120 miles to view a williams 1 at a dealer and it was gorgeous!!! i put down a deposit of 1.5k and the rest which i wont say was to go on finance... the dealer said to leave it to them and they would sort it.. there website says GUARANTEED FINANCE even if you have a CCJ (which i have).well after i had been up there on the wednesday and left my deposit i waited and heard from them on the friday and they told me they were having trouble getting the finance for me but they said they were gonna try another avenue and to ring back on saturday... i rang back on saturday and he then told me he was going to try this other finance company but it wasnt open till monday.... so i waited till monday and didnt get a phone call so i rang them on tuesday and he told me the car had gone!!!!!!! so now they are sending my deposit back to me via cheque!! the bad thing about it is that i found out from my mother that i had money tied up in premium bonds!!! should the paople at the car place sold it behind my back??? and they should at least pay me back the £50 i paid in petrol to get there shouldnt they... I AM ABSOLUTLY GUTTED........
 


Bang out of order.. cant help with where you stand legally but suffice to say if that was me Id be making sure I was aware of my rights and that I got adequately compensated!

petrol u could blag out of them, just use the ol naming and shaming blag.

Not sure where u stand legally either. Id imagine they can prob sell it at anytime even if you pay a deposit.

If you have a deposit note saying the car ,reg and model with deposit paid and youve still got it then youve got them by the short and curlys,you could chase it through a small claims court and make them source you another one of similar standard and offer it to you at the same price that was agreed on the deposit note...But without that deposit note youll get nothing.

Alternativley go to citezens advice and they will give you all the bumph on whats what with consumer writes...

A deposit isnt a legally binding contract - it is just the precursory monetary commitment to show you want an item, and as such either party can pull out at any time.

It means feck all really, and people that dont get deposits back on items are the people who dont persist and take things further.

They could sell that car to whoever they want mate and you cant do a thing. Sounds like the interest rate on your car is gonna be sky high if youve got a CCJ and theyre having problems finding you finance. If it was me in that situation I would set up my own finance and find the best possible rate, rather than rely on some shonky car dealer who wants to sell the car at all costs.

right i have the deposit note saying that i have put down a part payment of £1,500 and the rest was going to be on HP which obviously i was unsuccessful with! they have told me that they are sending my deposit through the post by cheque! so would best bet be to go to the citizens advice buereau? even tho by tomorrow i will have the deposit back in my account???

thats well out of order. Your better off getting your finance secured through a loan company , having the money in your pocket and either buying private or from a reputable dealer. These finance specialist car dealers are all about finance first and the car second.

Id just accept the cash / cheque, and put it down to experience.

Once the money is safely back in your account (cleared) - Then write all the letters you want - itll make you feel better.

Lets face it - what are you going to gain? - you cant claim for anything, and the car has been sold.
 


get the money in your account then go make their life a misery, thats not good business practice so make sure they know about it. Id have a word with the CAB and see if they can shed any light on the matter.
 


On the subject of finance, i actually work for a finance company and i find it very hard to believe they struggled to find you finance even if you do have a ccj, where i work we lend up to 15k for people with up to 8 ccjs/defaults in the last 3 years and the rates are around 17.9-19.9% around average for HP i should imagine.

Would do some more investigating myself mate, contact experian or equifax and get a prinout of you credit file to see if there were any credit searches done on your name and if there werent then they obviously havent tried very hard to find you the finance and are feeding you some bullsh*t.

As for where you stand legally i dont think theres anything you can do apart from name and shame em and make there lives a misery for a bit. Let us know how you get on.

Personally I would use the power of the internet and go every forum in the UK i could find, make sure the cheque clears first and then post up what a bunch of muppets this dealership/company are! Why take the deposit if they were gonna sell it to the next person, I think this is bang out of order!
 


16v jack where bouts you based, whod you work for if you dont mind me asking? i also work for a finance broker who deal with a load of companies who can offer loans to people with a list of ccjs/defaults as long as your arm
