urgent help on inurance - non fault accident

someone rear ended me on the 17th of november, and ive got an excess of £800 because it went up £400 because im under 21.

ive had a courtasy car for a month but they took it back now because the excess hasnt been paid yet as i dont have the money to fork out nearly £1000 on excess.

as its a non fault shouldnt the other insurance pay the excess?

i start work on the 5th of jan and i dont have a car to get there now. and i cannot get a courtasy car until my car is being fixed. and my car cannot be fixed until the excess ha been paid or waved, and i cannot pay this as i dont have the money.

So how long does that insurance have to pay the excess as its not my fault?

Really need help coz if i dont get a car by early next week im screwed.

As far as I know the other persons insurance should pay/sort everything. Yours shouldn't need to be involved afaik.

Untill the other companies insurance company admit liability i believe you have to pay your excess then it is refunded when the claim is settled.

Yup, normal sequence is that you pay the excess to get things started then it's repaid once the claim is settled. Have you asked you insurance for advise? It's a long shot that they will be helpful, but still worth asking the question. When everything shakes out you shouldn't be out of pocket, but until everything is finalised you might have to front some cash.

Interesting situation....

I had a none fault claim about 4 or 5 yrs ago, my ins company covered everything and then sought full payment from the other drivers ins, they even informed me that I could keep the courtesy car until the cheque for my car cleared, (it was a write off)....

I would be inclined to contact the ins ombudsman and request help from them, its not right you should be penalised for an accident that wasn't your fault....

Strange, if it's a full non-fault claim then surely it's not your responsibility to pay any monies?
My mum had a full non-fault claim and was given a courtesy car untill her cheque cleared (written off). The excess was paid by the third party's insurance and my mum didn't shell out a penny other than the fuel for the CC!

i believe it depends on the nature of the accident. i was in an accident last year and it was 100% the other guys fault... because of that they said i wouldn't need to pay anything, they'd just claim it all from the insurance company.

but i imagine if their is any element of doubt in their minds they will make you pay it, afterall you agreed to excess in the first place!
 
My dad had some guy across the road reverse into him. £1000 worth of damage, claiming through the other guys insurance but his insurance wanted him to pay the £200 excess so they could get the legal side rolling, he just wrote them a letter saying he couldnt afford the excess and told them about the price of constantly calling and writing to them to which they waived the excess ( claimed it back through the other guy ) and reimburssed him for his postage and all his phone calls.

Sorted !
