what happens in a 50/50 case?

recieved this statement from my insurer,

"Our view is the drivers involved may have to share responsibility for the accident but we will not offer or accept any offers on liability without advising you first."

just wondering what happens in this case, preferebly answers from people who have had experience but all welcome.

It's irrelevant, you pay your excess, the third party pays their excess and both claims are settled.

You both lose 2 years NCB and have to declare the fault claim for three years.

It's standard, 2 years is lost per claim from memory. No idea why but that's how I remember it.

If the insurer is claiming both parties may have to share responsibility, it sounds like its not a definitive claim rather both insurers trying to negate complications of a long drawn out process!
I would stick to your guns and depending on your original statement of what happened and witnesses etc i would refuse any joint liability and point the blame solely in the other drivers direction. Regardless of fault if you claim through your insurance it may still affect your premium, but you should keep NCB if protected !

So depending on the circumstances of the accident you will know if you were partly responsible or not so proceed accordingly.

i saw it to be my fault at the time but quickly retracted it due to new evidence, if i can swing blame BRILLIANT!! if its a 50/50 still quite good rather than full responsibilty and possibly a better chance of my car not getting wrote off, my word v his no witness in sight,
 
In a 50/50 each party pays 50% of the other parties costs. So your insurers pay 50% of his repair cost, excess, injury claim etc, his insurers pay the other 50%. His insurers pay 50% of yours, and your insurers pay other 50% (assuming your fully comp). Will not really change if you car is a write off or not.

You will both lose some NCB (unless protected), not automatically 2 years, but is with most insurers it is.

It is a fault claim for both parties, so you both have to disclose to insurers (any with any accident or claim regardless of fault) for as long as they ask, typically 3 or 5 years.

Just remember this accident tho mate, just in case in a few years the tables are turned, and someones trying to blag a 50/50 off your insurers, even though you 100% sure not your fault, and they admitted it at the scene, but you cannot prove it. Lets hope you not forced into selling your pride at the time as you cannot afford the insurance after someone steals your NCB
