where do i stand?

ok so heres the short version,

took a whole contract out, renewed it after 18 months with carphonewarehouse (initially with t-mobile) got told i was renewing it for 12 months at the same as before , £35 a month with a £5 discound although i may have to ring up to get the £5 put back on.

all the paperwork says 12 months, rwent online and saw i was paying £35 a month so fine i though ill ring them up, to get told no cant do any discount i was told wrong and i was on a 18 month contract not 12, so i told them i had the paperwork that said 12 months and what i had been told about the £5 and they said ok take it to your nearest store and show them the paperwork, so i did to basicly get told to f**k off i think the manager said "wasnt my store that did it, not my responsibility to fix it" i explained that i was told i could bring it there and it was a simple case of swapping it over, but he said no couldnt do anything/didnt want to

so i ring up tmobile direct after 15mins on hold get told to fax my paperwork over to them, get given a fax nmber that doesnt work, so ring up again get another fax number and she tells me she will ring me back as soon as she gets it, i have a print out of the fax confirmation yet never get a call back,
so lodge a complaint with carphone warehouse online, get an email telling me to fax my details over, so i do from work, no reply again so i email again (as you cant complain over the phone apparently) no reply

if i just cancel the DD what will happen, as the contract i signed isnt what im getting, was completely miss sold the product, im quite happy to just send the phone back

If you have the contract that states you have signed a 12 month contract, then i wouldn't worry about it.

Why not try another carphonewarehouse store??

Try taking it back to the store you purchased it from if not write a letter or email to them very long and showing your not happy with what they have done i.e staff not being helpful etc

its open 9-5.30 i work 8.30 - 6 about 20 miles in the opposite direction lol
 
You should have some kind of cooling off period in the contract anyway? Tell them to go f**k themselves. Just write a letter telling them you want out, send the phone back and cancel the DD. Done.

Grass them up to the Regulator if you dont get any joy.

It look to me that they made an error.

The Reg beats us with a big stick if we fcuk people about with their contracts.

i thought you always have 14 days if your not happy take it back, they have to accept it, thats what ive always been 'told' any way, debatable if its true though, i hate phone shops!!!!

Pretty impossible to print out paperwork for a 12 month contract if they've issued it as an 18 month so a big c**k up somewhere, probably dodgy computers.

The £5 thing sound odd, I've learnt don't take anything for granted if its not on the contract. I was suppose to get £50 cash back some years ago as an additional incentive for buying that day but it wasn't on the contract and I never did.

Bottom line is, you've signed for a 12 month deal, they can't put you in an 18. Over the phone they have to accept verbal but can't instore. Ring up the store you bought it from in your lunch, tell them your name and address, they'll see on the system what contract you're down as. If its 12 months, then tell them to sort it with T-Mobile. If they say its 18 months, tell them you've got the paperwork in your hand, signed for 12 months.

I'd guess they'd rather cancel the contract than shift it to 12 months, but its a guess. Or they may ask what you'd prefer: cancel or change to 12 months.

seems t-mobile are f*****s for doing the 12-18 month thing. they did it to me a few yrs ago, i stressed that i didnt want an 18 month contact and guess what, i ended up with one. nobs, i rode mine out anyway
