Whiplash payouts!

I was hit up the ass yesterday by some b**ch in a landrover discovery, destroying the backside of my car :mad: now my neck f*cking caines...

has anyone been in any accident and claimed off it? Just wondering if its worth the hassle trying to get some compensation out of it!

sorry to hear about the car man. how bads the damage?

guy at my work was given £2000 compensation for needing to take 2 days off work after a similar thing happened to him.

will be worth it if they pay out i suppose.
 


same here i had a guy pull out in front of me while i was doing 60mph he gave me 15 meters to stop in

i stopped in 16 meters

my neck started to hurt in the first hour where i went to hospital then my solicitor appointed by the insurance company sorted the rest after 10 sessions of physio i occaisonly get a sore neck 2 years on

the pay out wasnt that great but it was ok

Trust me it is worth it. when iw as in a car accident, i hit my shoulder, had a few injuries, i got treatment on it, which was physio, and i recieved a nice lump of cash, and now i feel much better !!! :D

it was my little 2003 1.2 dynamique, she was my baby! I would just have to drag the rest of my twisted chassis with the only 2 wheels that work (being the front 2!)

I would be surprised if it wasnt written off!

Thats bad news mate. A woman hit me not long ago and am in the middle of claiming - havent had any hassle so far. Only filled in a couple of forms and am now waiting on an appointment with a back specialist.

As for the pain, its a proper b*****d. I was told by my doctor it could last up to 4 weeks (and it did).

I might have to take a couple of days off work cos of it, so I might actually get a reasonable amount!
 


got £650 for it plus loss of work and sh*t totalled around £750 and tbh i was hurtin for a day or two but after that it wasnt too bad so as yours seems pretty bad id say around £1k ish give or take good luck buddy

its people like you with this "i must have compensation" mentallity that is putting our insurance premiums up every year

I was hit up the arse, would have been a piss easy claim but didnt do it, letigous american culture thats all it is

Never happend years ago unless a really serious incident occured
 


had a woman drive straight into my front passenger side on a mini roundabout and knock me flyin back across it.

There is no pain like whiplash all down ur neck and spine, i thought why should i have 2 weeks off work and be in pain because the stupid cow was lookin for a road name?

i got £1100 in compensation which £300 covered loss of earnings

But if u think Whiplash is a reoccurin thing so have time off work now and then so the rest of the compensation will cover that

To anyone who makes a claim can i suggest the following

Firstly if your insurances legal expenses puts you on to one of their panel solicitors ask the person who is dealing with your claim what their legal qualifications are, i can assure you that 99/100 times it will be someone with no legal experience and not even a para legal.

Secondly please remember that if you have been injured you would want to know if there is going to be any serious problems in the future, solicitors are using doctors who are not suitable experts to compile reports ie i have three cases where for whiplash to neck and lower back a firm of solicitors in manchester are using a gynocologist to report on clients where it should be a expert such as an othopod. If they dont give you a proper examination and provide a proper prognosis then say in years to come you realise the injury was far more serious than first though but you settled years ago your buggered! you cant go back for more.

Thirdly please remember ambulance chasers are the lowest of the low, they dont give a f**k about their clients who are just bulk work, if you have injuries more serious than a whiplash seek out a proper law firm who say do union work so that your claim receives proper attention.

Yes you can get good payouts but your solicitor gets more! say a claim for £1000, your solicitor will put in a fee note for £2-3K!

I am of the mentality that unless I cant work and earn I wouldnt bother, I wouldnt want some one to claim all they could from me if I had a genuine prang and was civil about it. It would ruin my chances of getting insurance!

But what I will say is I dont like 4x4s especially when its a tiny woman driving who can barely see over the steering wheel.

I nearly got wiped out by such an incedent a few weeks ago when the dumb ar*sed woman driving some huge yank tank decided she wasnt going to give way and nearly monster trucked my front end!

Luckily I stopped intime for her to drive strait past me withough even batting an eye lid. Arrogance of people driving those things is outrageous!
 


i know at the end of the day its people claiming that put up everyones insurance however my insurance is £150 more expensive this year because i had a claim of no fault of my own yet it still goes up so id now be £150 out of pocket, secondly my car sold for less because i had to admit it had been involved in an accident say another £250 min and the fact i missed college work and such because of this and then finally the fact i had a painfull neck for the next couple of weeks, yes we do put premiums up but the problem is no on will ever stop so if u have the chance to claim and u have a genuine case then y not i estimate i lost at least £400 because of the incident my insurance next yr will be higher than it would have been as well so its an ongoing problem u have through no fault of your own

My mate was in a car accident a securicor van piled into the back of him he was lying in a hospital bed for 16 hours thinking he had a broken neck which luckily he didnt and he has had 3 weeks of work so far because of it.

That definately warrants a claim i feel not a bad neck for a day.

If its genuine make a claim but dont put one in for the sake of it
 


Another reason premiums are going up is that insurers now have to pay for the cost of nhs treatment given out to a victim of a rta in the immediate aftermath of an accident, if you attened casualty its £435ish the insurer at fault will be charged and it can go as high as £30000 if someone is serioulsy hurt

Well Im in the process of claiming now. Just waiting for my medical, which is in 2 weeks.

Open fracture of the Femur (now made of titanium),Broken arm,Collapsed lung, Broken Ribs, Lacerated Spleen (sp),fractured skull, Fractured Jaw (now missing most of my right jaw),3rd degree burns to both feet, 7 days in intensive care, 12 days in the wards, and 4 months of work.

Needless to say Im still suffering 9 months down the road and cant enjoy driving as much as I used to.

I believe Im right in claiming but it does p#ss me off when people put false whiplash claims in!!

Not being funny lads but if you got hit up the ass, had your car written off, and couldnt go to work cos you couldnt get out of bed cos it hurts too much to do so then you would want some money too, and dont say you wouldnt.

I understand where your coming from with people claiming when there is no need, but when I cant go to work, then I will claim.

Well... i aint been in the situation where ive tried to claim compensation coz of whiplash....

BUT!

i went into the back of someone about 2 years ago and my car was buggered and his one was fine and he said its ok etc etc, and then he drove off n left me there, and one thing went to another with the insurance companies and then the f**ker tried to sue me for loss of earnings!!!

tbh, i wasnt gonna let anyone get away with that so counter sued him and won and he got nothing. So i just thought i would let u know from the othersides view!
 


I havnt read the rest of the replies....

but anybody who moans at your for making a claim, ignore them because...

1. its what you pay insurance for i.e. Legal exspenses

2. its a defo £1500 in your pocket, which is well worth it, seeing as your body has been damaged because of somebody elses stupidness.

i made a claim, got £2000 all in all, paid for this first year at uni (basically my education) and we pay high premiums, they arnt gonno drop low enough that everybody is happy just because u make a stand and say "no i have wiplash but i dont feel it is right to make a claim"

MAKE A CLAIM! IGNORE ANY NEGATIVE POSTS ABOUT IT



P.s. i didnt just make a claim coz of the money lads, i had my A-level exams at the time... so i was very pissed off at losing my car, also my car was shoved into a lad on a scooter so for about 2 secs i thought the lad had gone under my car :sick: (thankfully he was thrown clear and it was just his bike) and sitting in a 2 hour exam and u cant sit properly does kind put you off the exam.

On another note, that was the secound car crash i had been in, the first i wasnt the driver, but a passegner, we lost whole front end of the car, but nobody was injuryed, not a scratch or stiff neck.... so i didnt make a claim.

fair enough i think if you injuryed then make a claim.

I was on a scooter sitting behind a car staitionery and another scooter hit me from the back propelling me into the car in front which i hit supprisingly gently with my head and front of my bike. Me and other guy on the scooter where sparked out on the floor and he had a broken leg and both scooters written off. He got a couple of grand-his fault the accident was but he did get a serous injury-i got my scooter fixed which took 6 months which was a serious chunk of my scootering life and the cheeky b**ch in the corsa sued for whiplash. Dunno if she got it or not but you where talking a bit of t-cut to her back bumper-noway did i hit her hard enough for her to get whiplash

Your insurance company would have probably disputed the claim under something thats called MIST (Minor Impact Soft Tissue) effectively it means that in low speed accidents if the driver is wearing seat belts and has the head rests set properly there is no chance of their being a hyper extention of the neck

so all I say is if your are suffering from the smash then Yes claim. If your just after the cash then I wouldnt waste your time.
 


Above is worth claiming! That is a proper accident, minor accidents do happen and it seems the mentality on here is to claim and get a few grand - Do people not get sick pay from work and a new car/repairs into the bargain, why do you have to go that stage further and put in a claim?

I have suffered whiplash and its not nice but it doesnt last long (in most cases!) and claiming just fuels the ambulance chasing no win no f**king fee b******s that feed off the many who now see it as there income top up!
 


i claimed through CIS my insurance company who asked if i had wiplash, i said yes, they said well its worth making a claim for and we will set up up with a solictor blah blah, seeing as i paid for my insurance, which covers my car, and my body, i believe if my car gets damage i make a claim, if my body gets damaged i make a claim.

i had to quite my 6th form footie team and sunday league team coz of whiplash and sit through 3 hours of exams with it.

no matter what anybody says i will never regret making a claim, the major fact being it has paid for my first year at uni.
