tracking was out on the car, took it to a suspension geometry specialist today who confirmed the full geometry was out of alignment due to the subframe not being fitted back on properly (passengers front wheel is 7mm closer to the rear of the car than the drivers front) so ive got a full report...
Arnold clark couldnt get me a curtisy car for 2 weeks and want the car for 2 days to put right, so phoned RUK who are paying for another hire car for me on monday. getting somewhere!
thanks buddy, ill get the ball rolling in the morning see where we stand, they cant get it in for gear linkage fault for 2 weeks as they have no curtisy cars and need it for a few days (LOL! they get better every time)
but there isnt anything wrong with the physical gearbox its related to the same problem, gearbox was removed during engine change and not fitted/setup properly.
that was my way of looking at it, the sale of goods acts mentions you must give the seller 3 chances to rectify it within a resonable time scale before you can reject it, so id imagine engine change was 1, and then 2 chances to sort the linkage before rejection.
most of the stuff i can find online is basically saying you can only reject it after giving the dealership 3 chances to rectify the problem, but thats about as much as i can find
RUK arn't being much help either apart from getting me a curtisy car as the dealership couldnt.
just looking at other options as im going to loose a bit if i trade it in for something else.

if it was me id buy a nice standard 172/182 - make sure its running full health and enjoy it.
then at a later date some cheap mods - fresh set of genuine dampers, sportline springs, new track rods and ends, geometry setup, decent pads and a brake fluid change all of them will sharpen it up...
my mates just bought a MINT mugen kit DC5 to sell on, well hes in 2 minds to keep or sell as he already has a DC2 track car and i think has fell in love with the DC5 lol!
i dont see what all the hate is about with modern turbo engines for hot hatches, if done properly they are awesome, the 200 doesnt need anymore power, it does need loads more mid range grunt though! a 200hp turbo charged engine would have been ideal!
