Definitely not true. E marking does not define a road legal tyre (except on a Welsh Road Rally). I've seen non-E marked tyres on Police cars.
There are many tyres which are not E marked which are quite legal to use on the road. Go to a Road Rally (outside Wales) and you'll see many.
