I drive down that road at least twice a day, there are quite often parked cars whilst travelling in the other direction but parked up on the pavement, so you can't be "hammering it" because you're constantly having to give way. However, those cars are parked legally and in clear view.
Highway code rule 249:
All vehicles MUST display parking lights when parked on a road or a lay-by on a road with a speed limit greater than 30 mph (48 km/h).
This is a 40mph limit, we have proof that not only was she not parked close enough to the side of the road (not sure if that's valid), and less than 10m from a junction, she did not have her parking lights on...
An expert who examines cases such as this one said to my friend on 206info that although he went into the back of me, he has a very valid case to make a claim against the woman...
I'm not sure if there are any experts on here, but from what i've shown on here we can make a claim against her?

The google maps links gives me a view of what i can only tell is a flat straight bit of road in a village? The smart car was parked opposite the junction by the shingle driveway on the left?
So you stopped to give way behind the smart car and your mate drove into the back of you? How did he manage that when you can see for such a massive distance?

Firstly, you have no proof. Unless there was video camera in your car. The lights being on/not being on, is a moot point. You can't prove it.
Your mate has absolutely zero chance of claiming against her. Zero. He hit you because he was going too fast and he was too close. It's 100% his fault. What if you replace that smart car with a child? A dog? The easter bunny? Who would you claim against then?
The lights on in a 40 limit is probably true but it's one of those obscure laws that nobody ever pays attention too. Like it's illegal to have an air freshener hanging from your mirror. Nobody does anything about it.
Just get your mate to pay for the damage himself. Going through insurance will increase both your premiums (I know it's not your fault, yours will still go up) and then he'll lose vs the woman anyway.
I wish people would just accept a bit of responsibility sometimes instead of trying to blame everyone else.
Rinse your mates insurace. Don't forget a hefty whiplash claim too.
