Exhaust rust - MOT failure?

Just wondering if this rust on the backbox is likely to cause a problem come MOT time in February 2013?

If its not leaking it will be fine.

If the tester is strict he may put an advisory on it.

not leaking is fine. However another winters use might see that system off, so keep an eye on it
