Insurance Claim Please Help

Today someone drove into me whilst i was in my fiancees RT. he pulled out of a side rd into me - his fault. i also have a witness who is prepared to chat to my insurance co' (i have all his details). anyway this person didnt want it to go through the insurance and wanted to pay for the damage. on the way home i took it to a garage who said it would be a min 500 repair. i got home and decided to ring the fella and tell him i was claiming...... suprise suprise his phone was off. so i rung insurance co....... end of the story: i cant claim through my policy as we are 3rd party, even though its his fault. as 3rd party im only covered if he tried to claim it was my fault. but i can ring his insurance co and register a claim, although my insurance co wont help. ohhh and the guy who crashed into me has just got out of prison! and he had is insurance docs in the car with him?!!!? plus it was dated jan 25!!! how dodgy. think ive just lost a grand on the car. FFS just saved up for my big brake convo tooo

Try britannia or someone like that. They will take up you case if you have a witness. there are various companies the same who will orgaise repair courtsey car and recover the costs off the other party

wtf i thought 3rd party meant if it was YOUR fault you couldnt claim to fix your car...... but surley if its their fault you can claim on his???!!!

yep happened to my sister mate, some1 wrot off her clio, giving her false insurance details, adress, etc. good new is the police have found him, and are gonna punish him ;o)

i had quite the opposite happen to me i went into the back ofsomeone and i wasn't gonna clain didnt have much damage to mine then i got a letter through saying he was claiming liability and now they are paying for my damages so im getting pretty much a new front end

he has insurance, and ive registetred a claim and the car is effectivley written off. shame. just hope i get money out of his co.

also another question. when i reinsure my williams which is on my own policy as i was driving as a named driver in the car crashed above do i need to tell my insurance co'? as i crashed a car but it wasnt on this policy and it wasnt my fault?

You're supposed to tell ur insurance everything regardless...supposed to. If they ever did a check on (which they can do if you crash ur motor), it would show a total loss claim registered to you and your address, they'd want to know why u never told them about it.
You should have legal cover on your policy - that will pay for solicitors to put your claim through HIS insurance, remember as well that you can take ur car to whichever garage u are happiest with - it's a specialist vehicle, dont use their approved network in case they're joeys!

its not the williams that was crashed paddy, its my fiancees clio rt which i was a named driver on her policy. i dont have legal cover on that policy either. however i have claimed against his policy and the people at his insurance co (zurich) were very helpful - well, i have photos of damage and a witness and the fact that he pulled out of a main road into me means im gona win. the car is a writte off too as its gona cost 1000 to fix. i also rung my insurance co (DirectL) and told them what happended and they said id have to declare it but it wont affect me as it was the other blokes fault, however they mentioned i may have to register a total loss claim if i dont get any money back or just a crash with no liability if it all goes through, although they did hint that it may affect my risk premium group (how unfair it was his fukin fault) but at least ill still touchwood have 3yrs no claims, but "it woulnt make much difference". additionally my fiances clio is registered at a diff address so i may be able to get away with not telling my co' on renewal but id prefer to just to be legit and have no further issues with it. its fukin typical my other crashes had only just been erradicated last summer too *** sigh.

Hiya J_rt, sorry to hear about that dickhead wrecking your motor.

I used to deal with car insurance and I would advise you to tell your insurer but remember if by a slim chance you cannot recover your losses from his insurer then you can mention it to Direct Line and it shouldn't make a difference to your policy or your girlfriends policy.

What insurance companies look for is if another insurer has paid out but not made a recovery, that's when it can affect your future renewals.

By the sounds of things though you should not have any problems as you have an independent witness and the highway code states you had right of way.

I hope this makes sense, i do waffle a fair bit:eek: but if you need clarification just poost a message as I'd be glad to give my 'professional' opinion!

nice first post from gaffer. welcome to the forum mate.

sorry to hear about ur car j_rt, well the fiances. and wish you luck trying to sort it, i recently had a guy in a transit clip me and drive off, damage was minimal but he was a complete arse. ive contacted the police and id recomend you do the same as in all honesty it cant do any harm. theyve been very slow with me but have managed to obtain the driver who hit me's details and whilst they havent released them to me for obvious reasons they have told me hes insured, taxed and MOT'd which set my mind at ease.

cheers guys, ill just have to see what goes through in the end. bit annoying we're "car less" tho. prob gona take a while to get the money too no doubt. (if at all)
