Is this a MOT fail?

Hi all,
I have a phase 2 172. On the passanger side drive shaft inbetween the cv boots there is like a rubber bush or something (im fairly new to clios!)
However it is starting to perish. Is it a MOT fail? Do i need to replace it?

If there is excessive play in it its probably worth replacing regardless of MOT
