Minor Bumpish Question

Hi,

Let me start by trying to explain the situation as best as I can...

About 4 weeks ago I was driving along a road, approaching a junction at which I was going to turn right at, I had just finished college for the day and a "friend" was behind me in his car, as I was turning the corner he decided to try and overtake me (he was also turning right)...so to summarise a little so far "the friend" was on the wrong side of the road overtaking me at a junction whilst we were turning right, he cut me up once we had completed the turn and forced me into a kerb, which tired a shred from the sidewall of my tyre and damaged my alloy wheel.

I later text the "friend" and said he'd damaged my tyre, he apologised and asked if I wanted any money to cover the cost to which I replied yes.
He then backtracked slightly and said that I tried to out accelerate him on the corner which whilst I wasn’t hanging about I had no idea what he had done until he was near enough past me. Anyway he then said he’d go halves with me as he said it was half my fault to which I reluctantly agreed, my thinking being half is better than nothing.
The friend also said that he wouldn’t be able to give me any money for a few weeks as he is skint.

So after 3 weeks I asked what was going on, he said "I get paid tomorrow."
Great I thought.

A week later he’d not been in touch, so when we were at college I asked him about it to which he sheepishly replied im skint and have bills to pay. So I explained im not too flush either and im £90 out of pocket as I had to replace a tyre and have my tracking done. He didn’t reply.

I tried to phone him tonight, he answered but hung up. I then got a text saying that it was as much my fault as his, other people wouldn’t pay...so neither is he.

I thought the other driver was a decent lad who wouldn’t screw me over like he has, I now wish id reported the incident and claimed of his insurance immediately, however he has only been driving a few weeks and the cost of the excess and rise in premium hardly seemed justified for him after such a minor bump, just goes to show you cant trust anyone I guess.

I’m furious about this and would like to know what my options are as im sure they are limited with not reporting the incident immediately. I did however have a friend in the car from college who is both friends with me and the driver of the other car who has said he will be a witness to the incident if I wish to contact my insurance company. The other driver was on his own in the car and has no witness’s

I know very little when it comes to legal situations and would appreciate any help any of you guys can offer me.

nitro mors the word t**t onto the side of his car. perhaps a tad overkill but will certainly prove a point.

i had a problem with some coils that i bought but just a polite discussion got the desired result for me, but you've tried that. so go get some nitro mors ...

He's only been driving a few weeks and he drives like that?

Do every other road user a favour and claim from his insurance...make it too expensive for him to get a motor that'll cause even more carnage with an imbecile like him behind the wheel.

^ iirc hes on his mums insurance as well. So tempted to report him for frontin....after ive claimed ofcourse
 
I'd look into claiming against him, he sounds like a complete arse hole from what you've written. He's in need of a slap too.

completely offtopic but the worst part about this is i installed him a complete ice install about 6 weeks ago...headunit, sub, amp and components. Nice to know how people repay u eh?

and he drives a clio...he should be showing me big love lol

Just claim, regardless whether he's a mate or not.

tbh im 99% sure i want to claim now...hes proved hes not a mate.
Im not sure where i stand over claiming as -

1. it happened 4weeks ago now
2. ive had the tyre replaced (but alloy is not repaired yet)

Draw up an invoice for the work you did on his car, charging him extortionate amounts for labour.

Failing that drop him.

to be fair he did give me a few ££ for the work but it was far from what he would have paid for a pro install...but then again im not a pro.

lol not worth it really is it? im on an apprenticeship scheme training to be an electrician and have got to spend another 2 and half years at college with this lad.

Thats why ive given him every opportunity to sought things out amicably (sp?) but hes really proving what a tw*t he is.

Tbh mate . I'm not sure how you would claim now after the incident happened 4 weeks ago . It would be a case of your word against his and of course the witness in your car , yours and his mate , who might not want to get involved . It sounds like you've been very reasonable with him .After all , it was his stupid stunt that's put you out of pocket . You soon learn who your true friends are where moneys concerned .

If it were me i'd go with middos suggestion , nitromors or brake fluid all down the side of his car .

The guy in my car has said he will happily be a witness to the incident after the stunts the other driver has played.

Need to double check but im pretty sure the other driver phoned the witness up and said he was gona go halves with me on it all.

As tempting as brakefluid on his paint is....i cant destroy a clio....no really its just not worth it...will make me as much of a git as him and prob leave me with a criminal record

Well as long as the other guy is definitely willing to say it was 100% the other guys fault then i'd give your insurance company a call and explain to them what happened and take their advice on how to proceed .

Oh and if you do decide to use the brake fluid method , do it late at night when it's pitch black so you don't get caught ;)

phone you're insurance company and tell them the story and see what they say. It would probably be alright. Legal cover on insurance is for this kind of thing?

Keep your insurance company out of it, the minute you inform them you've been involved in an incident your premiums going up next year (and of the following 3 years) regardless of whether you follow through with the claim of not.

Some women reversed into me a couple of years ago, done £250 of damage she admitted it at the time, then phoned her old man to get the insurance details and he's started saying i just drove into the back of her. Anyway informed the insurance company, i had a completly independant witness standing 5 feet away fill his car with petrol, the claim went on for ages (6+ months), insurance companies will not bother making an effort to sought out £250 of damage, why, cos they know i'm not gonna claim on my insurance, loose my NCB etc cos it'll cost me more in the long run.

I dropped the claim in the end it was too much hassle and i wanted to sell the car (you also loose your no claims bonus until the claim is settled, so if your insurance comes up for renewal before the claim is settled your f**ked). For each year since i've had to pay an extra £75 on my premium due to a claim that never even when through.

I've now come to the conclusion that if someone tries to f**k me over like that, then there are loads of other ways to settle the score.

They wont give any info until he tells them who he is, the minute he's done that they'll be taking a note he's been involved in an incident, too late.

I didn't say report the accident I said to phone his insurance customers services and ask where he stands with it.

How do you go about that then , if you don't know who he's insured with ?

Legal cover on insurance is for this kind of thing?

What kind of thing ? A so called mate forcing you into the kerb . Legal cover is for if you end up in court for a serious matter .It will pay your defences bill .
 
What a mate, it was all down to him driving like a t**t. Paint stripper is abit harsh, I would be tempted to slash one of his tyres, or speak to his parents perhaps.

i agree with middo, however for the cheaper version of nitromorse, find a breeze block and surprise him at the nearest bridge/overpass
