Speeding





A mate just called me to ask what fine hed get as he has just been stopped on the M1 for doing 96mph.

The two interesting things about this are that the police didnt have a go at him for the speed he was doing. They however did give him a bollocking for not noticing the marked policecar in his mirrors (theyd followed him for a while!)

Secondly, he is American and driving on his US license. I guess they can probably fine him, but can they actually give him any points???

Id be surprised if hell even get a fine. I have friend who has a California drivers license and he got done while back over here on business. They did his mate who was in another car, but didnt do a thing to my mate.

I believe its too much paperwork.

Normally the following is the case.



You are allowed 10% + 2.

Therefore in a 70, you can do upto 79mph. Then between 80mph and 89mph its 3pts and a £60 fine. Thereafter it is a court appearance and upto £800 fine and ban.

Foreign nationals can be banned, but points are highly unlikely as the admin is too much, for the generally lazy traffic police of the UK.

I had a friend at uni who was French, and he got away with everything, because he wasnt a permanent resident. He had a drawer at home in Notts, full of parking tickets, producers and other official docs re his car... none of which was paid.

What was said to him; has he been issued a summons? If nothing was said, or he didnt have to sign anything, then he has escaped.

Well, in that case, itll be £60 fine. As for the points... unlikely. If anything more happens, then any half decent solicitor can sort it out. Was he alone in the car, cos if someone else heard the bobby say "it can all be sorted out in the post", that would help.
 


Yeah, alone in the car on way back from work. He said that the coppers were polite but a bit baffled as to why hed carried on speeding with them following them. Doh!

Right... have my notes from training in front of me.

(I am a Special PC but am on suspension at the moment, and have been since March, since was suspended from proper job - teaching - cos of an allegation made by a student... so have to refresh my mind a bit) - That also gives me an excuse for being a stroppy arse!

Options open to a constable in case of Road Traffic Offences are as follows:
1. Do nothing
2. Report for summons
3. Fixed Penalty Scheme

In case of 2., if issued with a summons, all details are recorded by the PC in his notebook, and the offender will be told he has been reported for summons. He will receive the documentation from a local magistrates court and the Police force in whose area the offence took place within 7days. He should receive a receipt from the PC on the scene, but no other documentation at this time.

If this has not happened, I suspect your friend has either been issued with a standard HORT(1) Driver Producer for licence, MOT, and insurance, and/or an Endorsable FPN for the offence SP30 which is exceeding the set speed limit on a public highway.

Indeed I hope it is the former, because a report for summons could mean a much higher fine, and at speeds above 95mph, often results in a 6-12month ban.

Double check with him that it is really a summons with which he has been issued.

Thats wrong because i got stopped on the M62 doing 94mph (after slamming on because i seen the copper on the Hard shoulder) and he gave me a £60 and 3points. Oh and a good bollockin too, he said i was lucky that id slowed down just in time!

Foreigner drivers get away with almost anything the police cannot do very much as there licences cannot have points on them.

If a foreigner gets pulled by the police they just get told to slow down. In extreme cucumstances (like the Japanese guy who filed himself trying to top 200) they can take them to the station and ban them for driving on british roads.

is an SP30 (3 points and a £60 fine)

court appearence is only when

over 100mph

double the speed limit

caught speeding twice in one week

but that dosent always stick they will send you a letter saying you are being summonsed? (spelling) but if you reply quick saying who the driver was they sometimes just send an SP30

Sorry chaps, but I am a trained Police Officer, and I have, sitting in front of me, from the Police Training manual, the chapter on Traffic.... it says you must allow 10% + 2.

EG.
30mph zone - Warning = 31-35
FPN = 36-48
Summons = 48+

If you get stopped at the roadside by any officer, and you are offered the choice of FPN or court appearance, and the officer states you were doing a speed within the Warning margin of 10% + 2, then take the court option. You will win. If you have recently paid a fine, then you have a fortnight to appeal.

That 100mph thing and being caught twice in a week, is crap. Sorry.

The advantage gained by being stopped rather than caught on camera, is that bobbies can use discretion. You (Boyo) were lucky that that bobby used discretion.

being caught twice is not crap im sorry but my brother got done twice in the same day by the same camera and was summonsed to court and that was the reason the gave.

and the 100mph thing is just what i have been told personally by 2 different police officers. not saying it is true but thats just what i have been told so who knows?

Anyway, not meaning to confuse things even more OR cause any arguments here but my next door neighbour is a Traffic Copper and ive read a few of his manuals and asked him numerous questions on all this when i got stopped (18months ago).

He said i was lucky it was 94mph because after 95mph but before 100mph, normally you get a court summons (this leads to a bigger fine and 6 Points) After 100mph you SHOULD get a court summons and normally it is an instant ban (upto the court to decide how long for depending on circumstances).

Sorry for any confusion but this is what i believe to be correct. Ill checkup on everything ive said tomorrow when i see my neighbour.

B*gger. 100mph is where the fun starts! ;) I cant think of a single motorway/dual carriageway journey where I havent done 100 for most of the journey! Its all b*ll*cks really anyway, as 100mph is only considered bad because you get an extra digit involved. If we were in km/h then I doubt thered be uproar by the dimwitted general public about doing 127km/h or whatever it is...
 


I got hit with an SP30 which carried 5pts and £200 fine for 96mph in a 70mph limit. It was the mobile camera van. I have a few mates who are in the Traffic department (only work with them since I am in the Fire Service), who tell me 1mph less and I would have had the 3pts and £60. Mine was a summons by the way.
