200 Cup accident with a lorry :(

  Nissan 350z
(sorry if the images are messed up, im essentially writing this post blind as my work blocks imagehosting websites lol)

Morning all,

Well what a s**t way to start the day with a lorry deciding he wanted to merge into my lane dispite the fact i was still in my lane. :mad:I have never had an accident before so i was pretty shacken up and didnt really know wtf to do but i grabbed his details and took some pictures now that its daylight.

The offender:

The location:
http://maps.google.co.uk/maps?q=52....o3N0rG-CIIEFQP3U2PRe9Q&cbp=12,112.92,,0,28.34

Essentially i was in a line of slow moving traffic in the left hand lane just coming off a roundabout and all i can assume is the lorry (which was on my right hand side) thought the car infront of me was the last car in the line of traffic so decided he would move accross into my lane (as it merges 2 to 1 ahead).

The aftermath:

To say im gutted is an understatement! As you can see hes done a proper job all the way down the entire side of my car and even has caught my rear wheel too. I was literally in the process of arranging with Harpham a winter detail session but thats now gone out of the window.

Ive not phoned my insurance yet as ive called Renaults accident support and they are currently trying to track down the insurance details based on the various details i provided to them. I have the details of the company the lorry is working for and also the details of the company that owns the lorry so im now awaiting a follow up from Renault accident support to HOPEFULLY report they have their insurance details and we can proceed to get my car booked in.

Fingers crossed it all goes smoothly! :dead:

Ouch.

I know exactly where that road is, terrible for morning traffic :(

Did the driver admit liability?

Hopefully if he works for a haulage company they will sort out the claim hassle free / quickly...

Did you take details of any witnesses?

  Nissan 350z
Bad news mate. Can all be repaired though :)

Thanks all. Yeah but the only thing thats keeping me on edge at the moment is the fact the lady i spoke to at Renault wasnt able to track down the insurance details there and then and she said she will call me back. I imagine this is down to the amount of different parties involved when its a HGV lorry but still, once that is confirmed i will be able to relax!

I do NOT want to have to claim this against my insurance!

His exact words were "i didnt see you there". But as you can imagine this story may change once he gets back to his depot. And no, surprise surprise dispite the fact i was in a line of traffic no-one bothered to stop to offer any details. I imagine the Mondeo estate infront was oblivious and the cars behind just carried on.

Im hoping the fact the damage is all down my right side only, and he "merged" into my lane that its pretty much his fault regardless of what he claims.

Its annoying when people dont stop but then most people just dont care.

The lorry company could be self insured as I know some of the transport companies our supplies use are.

Thanks mate i gave her that, the guy who answered said she needs to speak to someone called "Ashley" who owns the lorry and he gave her a mobile number. Thats the last i heard as she wasnt able to speak to anyone in the end. Fingers crossed shes has some luck later today.

When I was involved in an accident with an HGV when my car was parked, I hadn't even got round to contacting insurers when aviva phoned up saying the company had reported the accident to them.

Hope you get it sorted as easy as that!

TBH, I would try and deal with the company direct.

I had a Cement mixing lorry pebble dash my car on the A610 2yrs ago... it required a new windscreen and full front end re-spray.

I contacted the head office, explained the situation, they contacted the driver who collaborated with my story of the events, 2hrs later I had their insurance company contact me and say they would pay for all the damage caused. :)

Ok, it doesn't always work out this way, but perhaps mentioning you have witnesses and contacted a lawyer on what action to take may prompt them to take action?

I had the exact same happen to me and the driver tried to blame me for going into the back of him, despite damage to my old 206 being in the side of the car.

Luckily I had a witness!

I had a similar thing with a BT van, and I gave up in the end because it was like talking to a brick wall. Thankfully mine wasnt as bad as yours so I just paid out myself. Good luck with the repairs and hope it all gets sorted. :)

I've had one like this at a merger before. Had he signaled I'd have let him in but he just swerved so bad his rear wheel drover up and over my wing.

Best bit was he told insurance I wouldn't let him in and he had no where to go so had no option to drive into my therefore it's my fault, same insurance company as me so they approved everything within a few hours of it happening!

Hope you get it sorted without any hassle mate, a lot of the time side on jobs can go 50/50 it really just depends if they play ball or not.

If you need any advice at all about the repair or the insurance don't hesitate to PM me.

It's in the accident management companies interest to chase that for you at least as that's how they make their money.

In hindsight i probably would have if the driver was alittle more forth coming with the details. I also figured with my Cup technically still being Renaults asset due to the PCP i would allow them to take care of it.

Thanks for all the responses so far, some re-assuring some not lol.

I don't see logically how it can go 50/50 but we all know logic doesn't apply with insurance.

I was expecting worse from the title. Lets hope they get something posh to pimp about in as a hire car. Ha.

I think they often settle for 50/50 these days, as it saves millions in admin and legal costs. Sure, they pay out more, but the cost is passed onto us anyway.

Unlucky. Will come up good as new though.

I declined the hire car as mine is still driveable and i reeeeeeally dont want a 1.2 econobox. The damage is that way due to the low speed it happend at as the traffic was pretty much stop/start bumper to bumper stuff. To be honest i dont even know if he was indicating or not due to me being alongside his cab when this occured all i saw was a wheel out of my drivers window looming ever closer.

50/50? Laaaaame. :dead:

Aslong as your ok, think yourself lucky it could of been worse.
Its s**t i know, but s**t happens.

Nice shoes btw

What an idiot hopefully it gets sorted. Did the right thing getting pics and details easy to forget when you're shaken up.

+1!!! Earlier this year between Llangollen and Corwen on the A5 there was literally an accident in front of us where a car lost control and hit the roof of the car and swerved back onto the right side of the lane, car was steaming and bloke climbed out of car looking in pain and crawling, there was a car in front of me that literally drove around the car and carried on going!! I got out and made sure he was comffy and warm as he was complaining of back pains and he was bleeding.

Some people just don't care!!

Bad luck there :(

Dont settle for 50/50 if it comes to that, take it to court before doing that. Most people, when they know they are at fault, will give in when they get a court date.

  Nissan 350z
What good will a court date do mate, it would essentially boil down to my word versus his right? Dont think i can be arsed to drag the whole thing out more than it needs to be either, im not some CS millionaire like some on here i just want my car fixed so i can get on with my life :/

Still no response from RASL by the way since my initial phonecall this morning to report the accident. Excellent customer service so far... *sigh*

Just saying if you do take it to court it could scare the other party into settling as at fault. This has worked for a few people I know who were in a similar position to yourself.

It will take longer yes, but I know I wouldn't just accept 50% blame when it wasn't my fault.

Anyway, hopefully they will just settle it up quickly and honestly in the first place :)

Surely over the whole market the insurers pay out less by giving more 50/50 claims? Most cars are Comprehensive cover and they collect two peoples excess payments instead of one? Legal cover is usually by contract with the insurer and part of peoples cover.

Both parties also get a fault recorded claim which means more £££ from two people on the next premium.

gutted for you mate my 182 recently got wrtitten of and its gutting :(

Oh and also it was the other drivers fault but ended up 50/50 could have gone to court but with no solid proof it was never going to be a winning case. decided to take the payout and move on. sucks though cause i got less than 1k what i payed for my car etc but thats life hopefully yours turns out abit better mate.

What kind of insurer is going to gamble 10k+ legal bill for a 1k repair bill!

The policyholder would have to argue the case himself.

Insurance companies aren't stupid, nor are they a charity. They are a business, there to make money.

I hope the lorry accepts liability though mate.
