Back breaks keep locking on!

Does it mean there is something wrong with them. Sometimes sound like they are catching as well. If I touch brake it sometimes goes away.
 
I find that my rear calipers are sticky when leaving the car over night since I can hear the pads rubbing on the discs for the first few miles. It disappears after that and returns the next morning. I wouldn't worry if the symptoms are the same.

If you can park without handbrake over night it won't happen.
 
What condition are the discs and pads in? if they are at all scored or pitted the surface of one can grip the other even when you relaes the hand break. Before I changed mine, they were letting go with an audible 'kerrang', made worse if it had been raining...
