they wont take the passengers word or your mates word for it they will go on circumstances and photos of the crash site and damage.
thats what happened to me, taxi drove into me on a round about, my girlfriend was a passenger, insurance said she was biased,not because she was my GF but because she was inthe crash. the taxi driver got anothe driver from the same firm to come forward as a witness witha laws of physic bending explanation of how the crash was my fault. because he was the same firm his state ment through out, now because she is a lying b*tch, a year on its still unsettled and i'm still £470 out in damage repairs.
is ther no CCTVin the area, the council might charge you £60 for the tape, tho, that how much they were going to charge me until i looked at it and saw the camera was looking the other way at a guy jay walking dambit.
