Damage

Had a bit of damage done to my car this afternoon and I'm after a bit of advice on what to do. We currently have a building site at the side of my house with very little site security on it some kids have got into the site and thrown some bricks/stones over a wall and hit my car, Im covered on my insurance for accidental damage but my excess is £250 who pays it for the damage done ?

Public liability claim against contractor or house owner. It is forseeable that children would be attracted to a building site, write a letter enclosing a copy of the invoice for repairs, allege that they have been negligent in failing to secure and supervise the site, detail that the site would be classed as an allurement to children and therefore should have been properly secured and/or patrolled....

^^ Yep they should be liable; They'll have insurance against it - at least they should have...

depends on site, if its a homeowner doing the site themself they should have a policy like self build, if its a builder/contractor they will have public liability insurance under their contractors all risks policy, its sort of a case of res ipsa loquitur in being the facts speak for themselves, they would have to try and prove that they had taken all reasonable steps to prevent such an incident from happening ie fencing site off, locking site and if big enough having a guard

take photos mate of the erea and the way that the kids got in

i had a crash when i 1st started driving,over the crest of a hill,i got blinded by the sun and i ran into the bk of another car while it was sat at some temp traffic lights,no signs saying there were any road works or traffic lights,so when i got home me and dad popped bk there with a camera to prove there was no signs and guess what? - they had put up loads of roadwork+traffic light signs up after my accident

so take some pics so u can prove there is access into the sight

The building work has stopped and seems to be on hold atm. They demolished a large property and moved diggers etc onto the site fenced it off and stopped this is how the site looks now and its been like this for a couple of month

get in contact with the site forman.. if he is an arse about it get the phone number for the big boss man. should be able to claim on there insurance. take photo just incase...we had this on 1 of our sites a few years back..lucky i have a sound boss and he paid for the damages...fcuking kids!!!

no joy with the site forman or the campany owning the site, My insurance said i dont have a chance and to top it of I've been left this to drive while they remove the dints and respray my clio, Should get it back on saturday hopefully.
