Insurance Claims Grrr B*st*rds

Hello people,
just after some advice on what to do and what you think :D
Well i had a bit of a crash last friday in the after noon, i came onto a miniroundabout indicating right to come back on my self and go down the road i had just been but as i got to about 11oclock (if clockface was roundabout started at 6oclock lol) a shitty blue peugeot 107 pulled out and i went into the side of it :mad:

The 107 was a driving instructor! i dented his door in and his rear panel behind the door. my little beauty was hardly damaged just a chunk out of the plastic bumper and the plastic part above the bumper was split.

after 30mins on the phone with my insurance and 5 dfferent numbers on the phone with his, im no further.
I had a call from his insurers on voicemail about 30mins ago sayin ring them back and they are going to sort out my vehicle repairs but with no name for reference, so i thought RESULT, ring em up...."i dont know who spoke to, but our client hasnt admitted liability"
WTF help me please!!! :dapprove:

Who is liable? im sure i didnt do anything wrong but im begining to wonder.
btw im 17 and this is meh first "crash" advice would be excellent.

If you were already on the roundabout, with your indicator on, and he pulled out onto the roundabout, he is at fault.

You had right of way, he has failed to give way to traffic on a roundabout approaching from his right.

yeh i agree, if you were half way through going round the roundabout he was in the wrong to pull out on you......and recommend anyone not to learn to drive with him whoever he is lol

I'd ring up the guy concerned and 'have a word'..... the guy is meant to be a driving instructor, he should know he has done wrong. If it happened exactly as you said, and he pulled out whilst you were on the roudabout then it's totally his fault

Use your own insurance company in situations like this. Phone them up, explain whats happened and they will agree he is at fault, you were already on a roundabout when he pulled out in front of you.

You need to chase them or nothing will happen. Give them all his details and let them do the donkey work. :)

This is a relatively simple case for them - he has no arguement unless you've bent the truth in your thread and its not quite as described.

I would also call him and discuss the matter with him.

Matt this is a tricky situation. Personally, I would just phone your insurance company and ask their advice and how you should proceed. You pay your insurance to them - they are there to assist you.

You've had an accident. Its not your fault. You have a witness. Simple.

Do it and don't let them go until you have all the info you need. Are you getting a courtesy car - when is your car going in - also think about your excess and claiming that back - ask what the procedure is for a non-fault accident.

Ask for a copy of anything that sounds important, references and stuff, to be sent in the post and remember to write down who you speak to, when and what was said. Make sure you keep everything together.

Been there, done that. :)

Is it normal for the other persons insurance to be contacting you directly and not through your insurance company, does not sound right to me, as others have said ring your insurance company and get them to sort it out, that's what you pay them for.

If his insurance company rings again just give them the phone number and a referance name to talk to someone at your insurance company, try not to talk too much with them as they may try to get you to admit fault or get out of the claim.

ok will do guys, awesome advice again lol cnt see how the sneaky b*****d thinks it my fault! what a pr*ck blokes sposed to be a driving instructor, his quote after the prang was "well s**t appens dunnit" thats constructive one, coming froma driving instructor !

It is common for an insurance company to ring up the other part if they are going to admit liability. UKI are quite good with this. They phoned up the other party in my accident (and also another case i know of), got him a courtsey car, and paid him directly for the loss of his car/ personal injury. The thinking behind that, is that one it saves them moeny, and also if people have a positive opinion of them, they are more likely to go with come renewal time.

But if they they are not admitting liability then they must go through your isurers.
