Insurance not fighting my corner

  Mustang, S13, AX GT
Hey, I just had a crash earlier today in which the below pic was my car after (yes, that is the front bumper wrapped around my wheel) and just after having some new sideskirts on there :( I was pulling right out of a junction, I checked right road clear, checked left being allowed out, checked right enough room to go, pulling out and WHACK!!! The guy must have been really moving coz that fuckin hurt! I ring my insurance and tell them that I was pulling out but the guy was clearly speeding and there was a witness and the insurance tell me I'm liable! I ask that even if he guy was doing 100+ mph if I would still be liable and the answer was yes??? this cant be right

unfortunatly the other guy had right of way whether he was speeding or not so its probable that youl loose this battle

we'll soon see, I fear that I have lost and that my no claims is gone again but like I said they wasn't doin a few miles an hours over, he was really moving. Had he been doing the speed limit I would have had plenty enough time to pull out. so unhappy when my car got towed away

Unless you prove they were speeding and the damage to your car (IMO) isn't enough evidence as its not huge.

Shouldn't be to muhc to fix up new arch liners are £15 from Renault second hand bumper say £60 then hopefully not much suspenion damage might have worn the ball joints a bit.

Its not right but at the end of the day rules of the road are that you don't have right of way and are to blame. The only expction is if you can prove they were going so fast that you coulnd't know the car was coming ie it was coming round a blind bend.

The plan was to get equal fault, that way maybe i wouldn't have the costs of his car to worry about and i could fix mine outside of insurance. I accept that he has right of way but dont accept I take full blame as rules of road and the law is to stick to the speed limit. I shall see what my insurance say when they have had a look. the suspension etc all feels fine and the car once i had ripped my bumper out was driveable and drove fine.

I agree but the rules say your in the wrong. Rules of the road regards speed limits are difficult to say for sure driving above the speed limit doesn't place you in blame for a crash you maybe involved in.

they will argue, you should have judged the speed of the other car. its a s**t but i think you will lose this fight mate. Feel for you mate its the worst feeling!Hope you get it all sorted.
