Is this load compensator right on 172 cup

Hi all just getting my car ready for mot and noticed that the load compensating valve has a spring on it attached to the axle, I thought on cups these were fitted but not used? Previous mot shows fails for rear brake efficiency so wonder has someone fitted one to make it pass? Should I leave in on for mot then remove?
