more about oem software

we had a meeting with ms the other day to try and get some more info on licensing as we are selling off part of our company and we were discussing oem licensing and the rules regarding it

situation
you buy say office 2k3 oem from a supplier you then install it on a brand new pc. is that legal

their answer "yes" altho the supplier shouldnt be selling you it unless your a ms partner or a registered system builder but the fault is with them and not you so aslong as you have the coa your ok :). but you are not allowed to install it on an old pc thats a no no :)

ms admitted that its all a bit of a balls up as there are only 19 iirc fully authorised ms software resellers that are fully up to date with licensing regs the others usually give you out of date info or just plane wrong and they said that they know its an issue and are trying to resolve it as is been seen with the new licensing info for office 2k7 where you are only allowed one oem media pack per company then you have to buy the licenses seperately

well, there has been an announcement by MS today regarding office 2007 oem and its basically now nearly impossible to purchase it illegally.

Basically you have to by a media kit but as mentioned you are only allowed one of these if you can prove to MS that you are a system builder and unlike before they are checking on people and we are finding that distribution won't even sell it us to sell on unless MS have given permission.

Then you buy the licenses that can only be used once and will only install from the media kit supplied via the new scheme.

Basically they are telling us that they have now made it very difficult to buy OEM when not entitled to it, whether that is a case will remain to be seen.

The new thing is that most pc's will come with office 2007 pre-installed and if you want to purchase the key for it you can and this is going to be the new equivalent of OEM really, its already installed by the manufacturer (i.e. HP are doing this from APril I think) and you just buy the key if you want to activate it.

Some big changes, I think I deleted the email unfortunately but i'll have a look.

got it, it gives a brief overview of what i also read.

Dear David Knight,
The launch of the 2007 Microsoft Office system represents the most significant Microsoft advance in over a decade. We are making huge investments to drive demand and we are confident that your customers will appreciate the breakthrough benefits and will be inspired to buy licences.

System Builder licensing is changing...
It is about to become easier and more cost-effective for you to sell the 2007 Microsoft Office system on new PCs. With the existing programme you can purchase Microsoft Office 2003 System Builder licences from an authorised Microsoft distributor in single or multi-packs and are required to preinstall the licence on a new PC. With the new programme for 2007 this becomes a two-stage procedure which offers you more flexibility in sales times.

... to the new Microsoft Office Ready programme
The new Microsoft Office Ready programme makes it easier to sell Microsoft Office software to your small business customers who are buying a new PC.
If the PC is Office Ready, i.e. it already has the 2007 Microsoft Office business suites preinstalled, all you need to do is sell your customer a Medialess Licence Kit at the time of PC purchase. There is no need for any installation by either you or your customer.
If the PC is not Office Ready, pre-install the Microsoft Office business suites by using the new Microsoft Office Ready OEM Pre-installation Kit (OPK) You can then sell your customer a Medialess licence Kit at time of PC sale.
If your small-business customer does not want to purchase Microsoft Office at the time of PC purchase, you can now offer them a free 60-day trial. At the end of the customer's trial period, you have the opportunity to sell the Medialess Licence Kits separately post PC-sale.
How you benefit

• Each time you pre-install Microsoft Office Business suites using the OPK you are creating one more opportunity to make a sale or recapture lost revenue.
• The opportunity to try before they buy builds your customers' confidence.
What you need to do
