so I got pulled by the police, I was doing 80mph down a dual carriageway which had about 3 other cars on and it about 9 o'clock at night.

he was very nice about it all but ended up giving me a warning and said if I'm stopped again my car is seized. I did my research and this is what I have found...

still fuming about it, guess he couldn't do me for speeding because he didn't actually catch me speeding he saw me and came after me but a set of lights had changed to red and I was slowing down from a long way away from the lights!

so watch out everyone, couldn't think of anything worse to be hanging over my shoulders for the rest of my life! p.s I'm 22 years olds so have a long life ahead of me driving "carefully"

2 ways to look at that mate, first is at least he never did you for anything, I am sure if wanted too, he could have got you on something, second is, I really don't see how he can say they will seize your car if stopped again? what for doing 34 in a 30 etc? nah, he is just trying to frighten you a bit....

You were probably doing 77-78 as Speedos are not bang on in these unless you've changed wheels and then you could be over the threshold. 10%+2 for most counties. So you would have been unlikely to be done for speeding. The police think they are saving lives by trying to scare young 'uns. They may have a point to an extent but it's still a bit off to assume all young drivers in Hot hatchs are idiots. I got pulled in my XR2 for nothing while a mercedes on my inside on a roundabout who was driving slowly on the approach and round the roundabout decided to show me what it could do and dissappeared. I got pulled at the end of the carriageway after pulling into the inside lane after the Mercedes had gone and
Pottering down at 70 in a car whose Speedo overread by 10%. I had some band gear in the car so I was in no hurry. No interest in Mercedes that broke 3 figures easily.

Just practice your poker face, politeness, know the law and keep one eye on your rear view even if your just doing 80 like pretty much everyone else does. I do 70 to save fuel and I am always in the way on motorways and dual carriageways.

Coppers are people like everyone else they get cheesed off and have problems at home and some bad coppers take it out on the general public.

that's the thing the 3 cars in front of me were going just as fast, and it was dark and there wasn't any cars around he just caught me up from miles behind

cheers for the replies everyone I will ring 101 later and ask if anything was actually logged against me or my car!

Yeah i wouldn't worry about it tbf!

Lets face it though, you've just said that you were doing 80mph (speedo speed) in a 70 limit and you got a slap on the wrist. Suck it up and move on.

I got a section 59(basically the same as the above) at about 22/23 in my 205 Mi16 for 'coming off a roundabout to fast' yes i was probably driving like a dick and i knew it but didn't winge about it.

wouldn't class myself as being a dick or winging but each to their own. I was just trying to voice my experience and let others know

from what I read last night it is both the car and the driver, so if the car is sold and then driver B is stopped their car can be seized even if it is the first time they have been pulled.

That wouldn't happen. Once ownership has been transferred the car wouldn't be seized.

OP said dual carriageway. Didn't mention the speed limit being a NSL or not.

Under section 59 they can and will seize your car and you'll have to pay the admin fee to get it released.

No wait.

You were barely breaking the limit. Fcuk tha police and their hatin'

Didnt say you were ;) i said i was at the time.

Either way and this is just my view by the way, but doing 80 on dual carriage way regardless of if it was NSL or other we all know is against the law, so why get so p*ssed about it? tbf ive known cases of people getting properly booked for doing the same and they just hold there hands up and say fair enough i was speeding and get on with it.

Im sure everyone knows on here the laws around speeding regardless of if you were caught by a camera or otherwise.. and if not they need more driver training.

Again thats just my view. Im not saying im a saint or anything but if i get caught speeding then i accept the consequences

Section 59 is dangerous IMO. If I ever got done under I would take it to European courts - it basically makes the police judge, jury and executioner.

you would take them to court? the police would be the judge jury and executioner though? I'm confused here sorry

Yes I do mate. Because I don't just have a license to lose, I could also lose my job as well. Just not worth it.

Save the speeding for track days.

fair comment mate I just love to open mine up down the country lanes of an evening around mine! as do all the bikes and other cars especially on a Wednesday night

I'm not having a pop at you mate. If you break speed limits the inevitable consequences can be getting stopped by the old bill. It comes with the territory.

Have you done any track days yet?

Let me add I've only done 1 myself but it was epic. Highly recommend them for getting speeding out of your system.

no I know you aren't mate I never said you were :) and I am aware of this and I have had to face the punishment and I only have myself to blame!

no I haven't yet in still planning a few more things on my car before I start track days! looking into getting a van for my daily drive and work, and keep my clio for track days sometime in the future, just 1 problem... £££

You were speeding and got caught, be a man and take responsibility for your actions instead of looking to pass the blame onto the Police office for doing his job. This isnt aimed soley at you but why is it everyone always has to find someone else to blame??

Copper was giving you the scare tactics. It's like me telling my little boy that Santa has crossed off Lego Batman 3 from his Xmas list.

as previously posted I have said I admit it's only myself to blame and I have to take the punishment?

I think the OP's point is more a question of proportionality.

If he'd received 3-6 points and a fixed penalty it sounds like he'd have just sucked it up and moved on.

However, being given this threat of having his car seized for any future infraction is much worse.

Personally I'd much rather have the points and would be distraught if going a few mph over the speed limit in otherwise favourable conditions put me on warning of having my car seized.

Apologies if I'm putting words in your mouth OP..

And this is how you get a section 59 FYI.

I am assuming this is what you got, though you haven't actually confirmed it.

Is it?

3-6 points and £100 fine is going to cost you upward of £300 once your insurance premiums are done.

Having your car taken off you and having to pay the impound fine (about £150 usually) seems like the better bet to me.
