I think the OP's point is more a question of proportionality.
If he'd received 3-6 points and a fixed penalty it sounds like he'd have just sucked it up and moved on.
However, being given this threat of having his car seized for any future infraction is much worse.
Personally I'd much rather have the points and would be distraught if going a few mph over the speed limit in otherwise favourable conditions put me on warning of having my car seized.
But even if he gets the car seized he'd only have to pay a fine to get it back. There wouldn't necessarily be any points on his licence (depending on what offences we're committed to get the car seized in the first place).
Given the choice I'd rather have to stump up a fine rather than getting a fine and points on my license.
Surely that's more proportionate than stinging him with 3 or 6 points?
