Tyres have caught arches, Are they still leagle?

Hi, i fitted these wheels today and stretched tyres, they have caught the inner arch by the looks of it, although i didnt here them catching ;(, I am gettin the arches rolled and then reffiting them but my two rear tyres have gauges in all the way round, im not sure if this would be classed as the tyre wall as its hard to tell with stretched tyres, i really dont want to have to fork out for 2 new tyres as they have only done 50 miles ;( !!!!, heres some pictures, if it helps at all the gauges are not deeper than the tread?

Id keep using them. The car will fail its mot if the wheels rub though.
