Yes you definitely need the dust cover in place.
Tbh it looks like as you've said, the piston has seized onto the disk. You can possibly free off the piston. Try lots of lubrication and wind the piston in. Then get someone to press on the brakes. Then wind in again, press on the brakes...etc...
