I won my insurance case!

If you dont know just before christmas I had someone drive in to me on the exit of a roundabout. There wree 2 left turn lanes and this guy in a van swung wide on the exit of the roundbaout in to me (he was in the n/s lane, me in the o/s lane). He wouldnt admit full liability claiming I veered in to his lane, and no fvcker stopped to act as witnesses.

After getting another threatening letter from the 3rd partys uninsured loss recovery company yesterday demanding I fork out £200 for his excess, I rang my uninsured loss recovery team this morning.

They told me theyve just had confirmation from his insurer that they dont wish to go through the courts so theyre coughing up for everything! WOOHOOO!

They tried it on 2weeks ago saying that as there were no witnesses they wanted to go 50:50. Obviously my re-iteration of the evidence I submitted was enough to persuade them I wouldnt admit to any liability.

I drew up a junction plan at work on CAD and used vehicle tracking software with the exact vehicle geometries in to show what wouldve happened and what damage would have occurred had his story been true and vice versa, along with photo evidence showing the kerbing marks on the traffic island and corresponding marks on my alloy.

Just goes to show that a well reasoned arguement and not giving in is the way forward.

nice one, some tw*t in a white van veered into my lane on a bend in the motorway I reacted by moving over to avoid any contact and he then starts tooting and flashing at me!

Cool news :D

Was little question of liability when somebody bumped me from behind ... but Im sure the well structured and clearly drawn out information made sure of that. For anybody who wants to do such things on the cheap ... a freeware vector drawing app called Inkscape is excellent. (Great for house extension plans too).

There is the outstanding problem of my current insurers still wanting to increase my premium even tho full liability was admitted by the 3rd parties insurers, the claim was fully paid by the 3rd party, and my no claims wasnt touched. Apparently Im a higher risk now even tho I was totally uninvolved or responsible in the slightest and everbody is just as likely to get bumped from behind by a bad driver ... WTF! Theyll be losing my business unless they change their position on this!

That sounds like normal insurance company practice mate. If you have protected NCB and dont lose any you can still get bummed as they just put the basic premium up.

Hence why protected NCB is pointless IMO.

Yeah ... trouble here is that my NCB wasnt touched because I wasnt to blame. Protection didnt even come into play since once 3rd party had accepted liability, everything was put back as it was and my excess was refunded immediately etc..

Other insurance companies seem to be able to differentiate between who was at fault and how that affects risk, Admiral cant :cry:

Ill find out once I get formal confirmation through as to whether I get bummed in the same way mate. Im with Bell Direct at the mo, but was with HIC at the time.

I have exactly the same problem, third party fault accident on the record and places like elephant want an extra 150 quid!

Ive found that Tescos/Priv etc do not load the premium when you add a third party - recovery made claim :)

Elephant = Admiral ... so not a suprise. Maybe Ill sue the 3rd party for the negative affect that his poor driving has had on my insurance costs ... I am not go to lose out for simply sitting in traffic minding my own business!!

when i was in my astra gte i let a guy pul out of texaco and he drove straight into me said he wasnt his fault as he wASNT GOING FAST ENOUGH? i wasnt even moving i watched him drive into me.some people will try anything
 


i have just moved insurance this year from elephant to admiral as they quoted me about £100 cheaper.

As i was insured with MODs on elephant, which have now been removed to reduce insurance. Admiral took it upon themselves to look at my records with elephant, see i had mods then increase my premium by £100!! Cheeky b******s didnt even ring to check. Just assumed i was holding the info back, and breaking the law.

They got a very strongly worded letter from me about it, but i dont know what good it will do. I hope its not a sign of things to come from them.
