Liability Disputed

got a letter off my insurance, saying the other party in my accident is disputing liability

i dunno how they have the nerve, an the argument is as follows:

"there insurance, tesco, are disputing liability stating that you failed to give way to there client on the roundabout"

right, how the f**k can they use that as an argument, it just doesnt fit in at all with the situation, for a start i must have been on the roundabout before they were, cos i came from all the way on the other side, secondly i was on the inner of the roundabout and they wer on the outer, thirdly they hit the rear passenger side of my car while exiting the roundabout

we were both coming off the same junction (2 lanes), i went for the right lane as i was on the inside, he went for left as he was on the outside, suddenly he went for right lane which i was occupying, bang, he hits me............simple as that

i dont have a clue what they have said exactly but it doesnt fit at all with what actually happened......!
 


Hi Brun best thing to do is draw a diagram with arrows etc pointing out what had happened, when my dad was invlove in a crash due to the fault of the third party they try to get out of it too, however i drew a daigrams with arrows etc explaning what had happened and our ins company send out a private investigator to the spot to take pictures of the road, after that the third party paid up

Draw the diagram as stated above and get pics of the damage, i believe this is standard insurance procedure as the DONT like to admit to anything too quick, they are just trying to wriggle, Have you got your insurance involved? did you report it to the Fuzz? any witnesses? Fight them all the way and get your insurance company to get off their arses!

yea, the thing is though that they ask for 2 diagrams as standard, so they already have em, im gonna draw another one though, bigger, and write up more of a description

Theyre f**kers arent they m8? A mate of mine tapped a geezer at some traffic lights (when I say tapped he litrally hit the guy at 0.5 to 1 mph) the sum total of the damaged was a cracked numberplate. Two weeks later my mate gets a letter from the other guys solicitors saying that hes been off work and concust, feeling stressed about driving again etc! He was stood chatting to my mate for about 10 mins before they both drove off quite happily. Its a right piss take but I suppose evryone tries it on dont they?

People just want to string things out mate. Just means it takes longer to get the claim through!

Plus I guess they are trying to pressuring you into saying lets drop the claim and forget about it!

When a friend of mine had an accident a short while ago, I helped her case by taking a couple of digital photographs of the accident site then marked out positions of both vehicles, direction travelled etc and both e-mailed and printed out hard copies to send to the insurers, together with a signed statement from a witness who overheard the guy in the wrong, admitting it was his fault, but then who later turned round and blamed my friend.

Apparently insurers tell you never to accept liability, and they always blame the person who isnt their client, and hopefully, just as my friend had, you should have legal protection when the insurer appoints a lawyer to fight it for you, although it often takes forever, but in my friends case, she won and got the cost in full for repair and with a good bodyshop, the car was just like new again.

hang them out to dry mate, with a piss poor reply like that they are clearly clutching at straws! Just make your side of the situation totally stand out and blow theirs away!

Not really related, but on Fri my mate stuff his Clio Extreme into a ditch. Its gone into Dutton James for the estimate (think it will be a right off), Spotted your stripped out car being repaired!! Did you end up paying for the chasis repairs????

ill have a look for your mates adtmits when i go an see mine, might call up today actually see how its comin along, and how was mine lookin !?

yea im paying for it dont wanna go through insurance too worried about them writing it off, and the whole hassle that brings of me trying to get my car back

at first he said it might be up to £400 extra, but when i went down he said £200-£300, an i think the last thing he told me was £200, i called yesterday an the guy repairing the car said the panel had cost about £100 but wasnt sure if he was gonna charge me the extra labour or not

They seem to be really good, however, a little slow. My mate has had to wait 4 days for them to sort the estimate, now waiting for renault insurance to get someone down there to take a look. You wont see his in the body shop, more likley at the rear, as it isnt gonna be repaired in my opinion. £5500 for parts before labour was the estimate. This would include re-shelling the car!!!! It really isnt that bad, it just the damage is all over and the shock of hitting the keb has rippled the roof.
 


My Dad had a similar accident but someone tried to go all the round a roundabout in the left lane (Dad was going straight across in the right) and they hit his passenger side. The other party tried everything, said he was speeding, driving recklessly etc.

It was going 50/50 and the insurers werent willing to drag it out so my Dad asked one to come round to meet him. He took him to the exact place it happened at the same time on another day... Packed with traffic, so proved he wasnt speeding and the insurer got a good look at the roundaboput and agreed that the only way there could have been an accident was because the arseholes couldnt drive! Ask if you can take a claims guy out to show him what happened... At the end of the day they have to make an effort or theyll lose out, either with costs or losing you as a customer... Make sure they know this.

Im sorry this has happened mate, but I know its going happen to me one day too... Some people are just w**k drivers but wont admit it.

thats a good idea that, never thought of asking the investigator to come to the site with me. Kinda gives you a chance for a face to face explanation too.

was it a greeny/blue one mate ?......Gordon at Dutton James mentioned somethin to me about the air bags goin off, an the cost of sortin that out....or maybe i didnt catch what he said properly as i was gettin my car back today an i was excited

Always carry a camera in the car. You can use it to take photos at the scene, and take photos of your mates at the beach.

Yeah Cyclone Blue Extreme. Airabg and seat cost is over £1k to start off with. Awaiting engineers report from Renault. He still has no courtsey car!!!! Glad I paid the extra with directline for the garanteed courtsey cover

he will get a courtesy car mate but until your insurance have given the bodyshop the go ahead then they cant offer you one.....i was drivin around in mine for a week or 2 before they could start the work, waitin on parts mostly for mine
