THE LITIGATION between Apple and Samsung is escalating, with Apple accusing Samsung of harassment in its request to see prototypes of the Iphone 5 and Ipad 3.
At the end of May Samsung filed a discovery request for Apple to hand over future products to it for inspection, in reciprocation for a court order it received to hand over its upcoming Galaxy smartphone and tablet models. It claimed that it was being put at a major disadvantage by having its future products exposed to a rival when those of that rival were not also shared.
Apple has responded to this request by calling Samsung's request "misconceived", "simplistic" and "unavailing". It said that its claim that Samsung infringed its patents relates to current products, not future products, and that seeing those future products could have no relevance to Samsung's defence.
Apple claims that the previous court order that Samsung must hand over its future products to Apple was made on the basis that images and samples were already released to the public and that they were seen by Apple to be infringing its current products.
It said that Samsung previously filed a response to Apple's request to see its upcoming models relating to various documents and surveys. Apple agreed to meet about this and provide the relevant material if deemed necessary, but it said that Samsung since withdrew that request and opted to file a new discovery request related to Apple's upcoming product range instead.
It said that its future products are extremely sensitive trade secrets and that Samsung offered nothing but "rank speculation" about them. It added that Samsung has not shown that future Apple products are directly relevant or central to the case, and therefore its motion should be denied.
In fact, it went even further and said that Samsung's filing was not made in good faith that it was rather a "transparent and improper attempt to harass Apple".
The dispute began in April when Apple accused Samsung of copying its designs, down to the packaging. Samsung countersued and it has been a tit for tat legal battle ever since, with both companies becoming more embittered in their responses. Suing for past products is one thing, but now that the future products of both companies are on the line neither party will give up easily. µ
