Spoiler break light?

Car going in for its MOT very soon and my spoiler break light doesn't work, it doesn't bother me that its not working but im not sure if it will fail its MOT or not. From what i understand if it is there it needs to work and i can't take the spoiler out as its got the screen jet in it too

Any ideas what to do? Will a ph1 spoiler fit?

3rd brake light does not need to work for the MoT. It'll be an advisory thats all.
