Car  BMW 330D
Well where to start!. Driving along following my mate in Leek. Car pulls slightly out into the road in front of my mate, he brakes, i brake my mate stops to let the car go(which i wasnt expecting) bang straight into the back of him. My front bumper gets ripped off bonnet is fucked and a headlight.:( :dapprove: .Copper had me in the back to interview me etc says he reporting me for driving without due care and attention, so bye bye to my license :( as he said ill probably get 6 points and i havent been driving for 2 years yet.
 
ad that is absolutely gutting, i hope u wont be banned for too long if anything happens.
 
Thats wierd, a copper turned up at an accident where a young lad in a clio was involved?

I had a crash back in the day when i was 18 and they threatened me with points and a fine but i got 'let off', i was sent on a 'drivers improvement course'.
 
wtf... harsh gettin 3 points never mind 6 points for going into the back of someone. accidents happen!
 
Ah, dont worry...

People have accidents all the time..... doubt it would come to this as you could say you were distracted by a cat / women / man / dog etc..
 
Copper sounds like a bit of a wanker... bad enough crashing into your mates car! Did he kick you in the balls for good measure?
 
Dont worry too much mate. I had a crash which was my fault in my first 2 years of driving. I was being done with due care but they offered me the chance to pay £150 and go on a 2 day driving course. I did this and, touch wood, still have a clean licence. If they don't offer you this, enquire about it. It will look good if you approach it the correct way...i.e you wanting to improve etc.

Ahh sorry Adam. Due Car and Attention is between 5 - 9 points IIRC. I've been done for it twice. You live and learn, no points or claims on my license now.
Its a horrible feeling having your license revoked but you'll be back! Thats if it is indeed a ban. You never know! :)
 
TBH mate, i doubt it will come to a ban. Depends on the magistrate i suppose.

Seek legal advice, approach it in a positive and mature way, i'm sure you will be fine.
 
Hope you don't get the points mate!

I got 6 in my first two years. Had to do it all again... theory and practical!! Only took 3 months and I got a better result than the first time... so why they need to take your licence god only knows!! It just costs a s**t load £££!!

any structural damage? seems pretty heavy...reminds me of rancidrancid (Loki) when he went int o a van. That wrote his car off.

hopefully the copper will realise its just an accident, no one was hurt and youll get "let of" as said before. if not id plead that maybe there was something on the road which greatly increased ur braking distance? could well have happened....its autum...leafs on the road? greasy?
 
No structural damage bar some support thing under my drivers side wing. Crossmember and slam panel are fine strangely :S . Just cosmetic stuff, but it looks bloody awful! :dapprove:

Copper questioned me about conditions etc, i said it had recently rained etc. so the roads were damp n stuff. Still was an arse about it tho :(

TBH tho as everyone has said, I doubt you will get banned! I crashed 1month after i passed and it was my fault (pulled out at a run-about when i shouldnt have :o) and the police were really sound about it coz i just held my hands up and said basically told them i wasnt paying enough attention!

But hey if you were scottish you would prob get a free day at knockhill lol!

Did the cop charge you with it there and then? maybe he was just saying it so that you s**t yourself?

Unfortunatly as the law states you must leave enough room for you to stop within the distance of the car infront of you.

  • allow at least a two-second gap between you and the vehicle in front on roads carrying fast traffic. The gap should be at least doubled on wet roads and increased still further on icy roads
  • remember, large vehicles and motorcycles need a greater distance to stop.
 
TBH its not the coppers decision ultimately. It will go through CPS and the the magistrates if it gets that far.

Careless is when your standard of driving falls below what could be reasonably expected of a careful and competent driver. TBH piling into the back of someone you could pretty much say that the standard of driving is not good enough. Having said that you may have had just a momentary lapse of concentration which would make prosecution seem a little harsh.

In terms of the Highway Code a breach of a regulation of the Code doesnt necessarily satisfy the offence but would be evidence towards it. And it does contain some pretty decent advice on Stopping Distances and driving according to the conditions.

However, in terms of it being in the public interest I dont really think it is personally, as you've smacked the back of your mates car and yours is nigh on written off. If it had been a stranger you hit my view would be different.

I also would have thought you'd be highly suitable for National Driver Improvement Scheme.

Remember what I post here is merely my opinion and it doesnt reflect policy or the law. Its just a matter of opinion.

could guarantee if it was an old dear driving she wouldng have a driving without due care and attention charge slapped on her
 
I would almost place money on you getting an invite to a drivers improvement course for 150 quid in stead of charging with driving without due care.
