BUS LANE PENALTY!! HELP





Right, im a bit confused. This did not happen to me but happened to my bird.

Anyway. She recieved a letter saying she was being prosicuted and fined a £100 for use of a bus lane on Romford Rd. This was supposed to have happened on the 15th of March in a Pug 106 with her reg!! Thing is, my bird wrote her car off on the 28th Feb and it was taken off to be checked over by insurance company on the 5th March! The decieded it was a write off on the 14th!! So it couldnt have been her. Is this allowed as it seems to me that they either fixed it up and sold it or sold it as a write off?

Also where does she stand with the fine and prosocution? Does she have to pay it and claim it back or just is she liable? Who does she need to speak to to sort it out. She has spoken to her old insurance company who took the car but they said it wasnt there problem and cant help!

What does she do?

I wouldnt worry about the fine thats for sure, but you may have to go to court to prove it.

Citizens Advice burou (spelling ?) would be your best bet

ask for a letter from the insurance company stating that the car was taken out of your GF hands on whatever date it was and from that point the car was never returned to you from the insurers.

You suggest to the police/isuer that they find the car being it either your old one, or a clone as it is probably driving about illegally.
 


someone could have the same make . model . colour car. saw yours written off . noted the plates had a set made up. voila! u can run speed cameras and bus lanes whenever u feel
 


Yep. Sounds like your cars been cloned! As long as youve got proof YOUR car was written off before the offence then youll have no probs!!

no its more likely that when your bird was paid out your insurers sold the salvage, and clearly someones put it back on the road (which u can do, not really a problem).

All you need to do is obtain a letter from your insurers stating the dates of claim etc, failing that get the police to check the MIAFTR register as that records all total loss claims and your pug will be on there. that should sort u out.
 


Same thing happened to one of our work vehicles.It was written off, so we got a pay out from the insurance and bought a new one.2 months down the line and we recieved a parking ticket for the written off vehicle.We just told the issueing authority about the write off and who dealt with it.Ie the garage that took it.
 


If the car had been put back together then they done it pretty feckin quick considering it was buggered.

She can prove the accident happened before hand and date as the police came to the accident as it was on the motorway and involved other cars.

Her insurance is crap though. It seems since she left them they are crap. She has been waiting since the accident for the cheque that they agreed for the car also they havent returned her MOT certificate other stuff as well as not helping or contacting her throughout. Now she has left them i dont think they will help in anyway and if they do help by sending a letter it will take a good month or so for them to do it. She has 28days to return the prosicution letter

right the worst thing to do is not to reply to the letter, just reply letting them know the circumstances.
 


Yup - your local Citizens Advice Bureau (Bureaux for plural) will be able to help. You shouldnt need professional legal help with this, but if you do, then the CAB is usually able to call on the services of a solicitor if needs be - depending on how serious your case is relative to others. I doubt youll need it on this occasion, but CAB would also be able to give a list of solicitors who give a free half hour consultation.

This sounds like a very straightforward case to me. I would make contact with the body that intends to fine you ASAP and tell them what you know and that you intend to appeal. Your insurance company will be able to give documentary evidence of the accident and when they wrote-off the car.

If youre having trouble with your gfs insurance company, a CAB letter usually speeds things up!

I wrote off my first clio X822 MOF (1.4 8v sport 2001) and the insurance company sold it, and some guy re built it!!! (i rolled it) Its back on the road!!!
