Right basically my HDD is corrupt (dunno how but it is)

tried repairing it by booting from the install disk and pressing repair disk in disk utility.

its basically told me it can't be repaired...

Could i just reinstall mac osx completely and boot from my time machine backup so i wont loose any data and my disk will be fixed?

also, if this doesn't fix it can i go back to apple and get them to replace it?

Brown.

Try the reboot.... mind you you may end up loosing all if it is corrupt.... have you got apple care?....or even still find a apple repair centre and just go down..... that way is better then ringing apple

these guys are contactable out side apple, they will then tell you if its warrenty worthy, they will ring apple

I would do a clean install from your install discs when and if that is successful you can use migration assistant to make use of your time machine backup after the OS reinstall

EXACTLY the same problem I had. It wouldn't reinstall OS X either. Had to have a new HDD.

Just remember, HDDs are the same whether it's a PC or Mac, so they will break on macs too.
