Help please - compensator valve on Clio 172 cup

Right, my cup has failed on the usual rear brake issues, the previous owner had fitted the rod between the rear beam and the arm on the valve so it was tested as a regular system. I have now removed the rod and the arm moves freely, however it sits at full extension. Is this normal? My eyes tell me that it will rub on the rear beam when the car is back down on its wheels, surely this is not right?

It moves freely with some sprung tension when you move it by hand, but when you let go it drops down to its lowest position. I've had a look at the vosa document and it appears to show a spring on the outside which holds the arm up which my car doesn't have. Is this missing spring causing this problem or should the valve stay up on its own?

Is there a spring that holds it up against the bodyshell? Or is my valve knackered and it should stay up on its own?
