That looks about right. There are times where a socket under the exhaust rubber just doesn't cut it, I think I had about 11 cable ties under mine at one point.
A worn dephaser sounds nothing like what he has described. Sure it's only when in gear? Tried coasting and seeing if the noise is there still?
Could potentially be clutch or gearbox related.

Leave it as it is. Cold air feeds often hamper the air flow to the filter.
Just as a guide, My airbox also looks like that, with no cold air feeds attached and standard filter, which ran a 177.8bhp at RS tuning
