Can you not think of a way of making it his fault (we know it is) its just just if the insurance decide to try & blame you for it.

id say this is what happened, im the black blob and the other vehicle is the red blob

when i rang up to tell the insurance, the woman said something along the lines of it doesnt sound totally your fault so she has put it forward to the negotiators to see if they can achieve anything, fact of the matter is, im supposed to give way to my right, im not sure if the fact he went over the roundabout is judged as a similar fault, he was in a larger vehicle so maybe it wasnt possible to totally go around it properly, however he basically cut it out altogether

Did he admit to cutting across the roundabout?

Did you explain politely that roundabouts are round for a reason? lol

the only thing i was concerned about Jilly was that my g/f was ok, she was havin trouble breathing at the time and i was tryin to get an ambulance asap

hmmm roundabouts are horrible things to claim on

just last night some bloke in a sh!tty escort drove round a small roundabout twice, didnt indicate or anything, just went round it, prob hoping id pull out so he could claim off me, gave him beep and finger

as for you, did the police take insurance details off him?? do u have any details from him?? hear what he had to say about things??

you see ppl everyday cutting mini-roundabouts in half, dangerous, its soo anoying because you know u would have been fine if hed used it properly

the other fella thinks its my fault entirely i think, im pretty sure he has a witness aswell, just have to see how it turns out

the police did take his details and passed them over to me, but this isnt a police matter now, its all down to the insurance

unfortunately i think it will go against you, due to the not giving way, as police cant be arsed it doesnt help u at all

basically i had same thing before, didnt give way to the right, because i had loads of time, however bloke was doing double the speed limit, 60 in a 30, + he was in middle of the road ffs

smacked into me and put my car into someones front garden lol,

anyway i refused to let him move his car and got police, no witnesses, although i got them to measure his skid marks, 50 metres down the road, policeman said looked like he hit me doing about 35, so 35, + 50 metres of slowing down, hmmm, speeding perhaps

as no1 was hurt pigs f*cked off and said insurance will have to deal with it, i proved to insurance that he was speeding but they said without police statement saying that im stuffed, lost the car and he claimed against me lol

on the bright side, im still alive and so are you and ur g/f, its just soo frustrating

that really sucks mate. we have a mini roundabout near us and i see people all the time cutting it, its so dangerrous.

Mate! just read this - blimey mate, glad youre both ok!
As far as a claim goes, get the wording right for you claim and do not derivate from it, make sure that you state you both hit the entrance to the roundabout at the same time etc, as long as you can state (and prove by way of a witness) that you both didnt give way but instead both entered the island you might well make it knock for knock instead of him claiming soley from you.

Just glad youre both ok, cars car be replaced (however costly) :)

Looking at your diagram, it is entirely his fault, if your picture is acurate, it is clear whois at fault, as you have passed more than half way, before he turns. Therefore he should have waited until he could see it was clear. Id keep on at the insurance, dont worry about what witnesses he has, you have your own witness, so just concentrate on your own claim. And push the insurance to claim from him.



Accidents suck, when the police dont back you up. Had an accident just over 3 years ago, car and i came together, i came off a lot worse, (but thats riding bikes for you), lost the lower part of my right leg, 5% use of hands, which isnt a noticable thing, 20% memory, and a whole lot of healing. And the police said at best i could hope for was a 50/50, i got nothing at all. Lost bike £4kish lost limb (priceless), loss of earnings (again priceless), he however had his Merc replaced, and he had compensation as well, due to him having his young son witness the accident.

i dont understand how the car can be a write off going at 20mph. unless he was going way too fast. surely it would only be the off side front corner that got stuffed in?

the subframe is bent and im pretty certain so is the body of the car

just been with my mate to get all my audio out, i was told last night by the fellas there that id best get my audio out cos the car could get moved anywhere once the insurance are onto it

and Clart, i didnt hit somethin stationary, the thing i hit was coming towards me so i guess it makes the impact worse ?.....it must do ?

there are planty of other cars for you to have just get ur engine back and in one!! get a 16v shell or something!

whiplash doesnt occur till the earliest the day after, it might last a while too, i had it slightly a while back and it was horrible for a week!

someone crashed into me in my old car by trying to overtake me on a mini roundabout (yes overtake) when i wa doing a 180 on it! i actualy went into the side of them, then they drove off! w**kers!
 


Gutted for you, was a nice car. I dunno maybe there is the brightside of a fresh new project to get started on? Up to you of course, glad youre ok.

depends entirely on the payout, the engine is certainly worth a few quid but id have to see how much the insurance would want for the car, and how much they give me, cos id have to pay for the conversion all over again, money which i certainly dont have !

Not wishing to put a downer on it mate but if it was a painted r/bout then they are known in the industry as over-runables.

You dont have to go round them, theyre just there to indicate the give way rules at the junction. If he was indicating and you werent then it could technically be you to blame Im afraid.

Hope it all gets sorted though for you. Im 2 months in to my claim with no progress!

If the damage to your car is frontal surely that will indicate the other person cut directly across the angle and not round the roundabout?

on a brighter side you could always buy a blown up valver and stick your engine in it and put all the other bits off your car on it.

ive already checked out insurance on a 16v and its not too bad, so thats an option

Balls. We put them in in many cases where it would be impossible and inconvenient to actually drive round them. Hence why theyre called over-runables

The above applies to solid mini roundabouts not painted (which includes humped).

It doesnt actually specify, central markings would indicate it includes painted ones as well, and I think in this case the other driver didnt make any attempt to go round just totally neglected it all together

i was going straight on, as far as i remember from my driving lessons, if going straight on at a round about its personal choice as to whether you indicate or not, IIRC

cant remember if i was or not, sometimes i do, sometimes i dont

somethin was comin from his right, i saw it approaching the roundabout as i approached it, which was one of the reasons for me slowing down
